Daniel Kay Smith, 51, of 2605 E. Center St., Warsaw, was booked in the Kosciusko County Jail at 8:11 p.m. Saturday and is facing charges for burglary, a Level 4 felony; two Class A misdemeanor theft charges; unauthorized entry of a motor vehicle, a Class B misdemeanor; and possession of marijuana, a Class B misdemeanor.
According to the probable cause affidavit filed Thursday in Kosciusko Superior Court I, on Saturday a man called police and said a man in a camouflage coat just stole things from his vehicle as he stepped away to deliver food for Door Dash. The man said several items were taken from the car, along with pieces of mail.
Later that same day, police received a call from another man who said he had just found a man inside his residence while he was home. The caller told police that once the man, later identified as Smith, realized he was discovered, Smith ran off with four wrapped Christmas presents from under the tree and a wallet. The homeowner chased Smith outside, causing Smith to drop the presents while he fled.
Police also found a red Door Dash bag with the dropped presents, according to court papers. The only remaining stolen item was now the man’s wallet.
Police returned to the original scene from the vehicle theft to review home surveillance footage, and it was then that Smith was walking by with a tarp over his head. Police ordered Smith to turn around, and when he did he was wearing the camouflage coat.
A search of Smith resulted in the discovery of the man’s wallet and a bag of marijuana.
According to court records, Smith was convicted of theft in Kosciusko County in 2018 and conversion in 2013.
His bond was set at $15,250.
