Winona Man Faces Battery Charges

A Winona Lake man was arrested after allegedly punching adults in their home and threatening to kill them if he gets arrested for it.

Larry Duane Potts, 39, of 1202 Wooster Road, lot 13, Winona Lake, was booked in the Kosciusko County Jail at 3:58 p.m. Thursday and faces charges for domestic battery with a child under 16 present, a Level 6 felony; two counts of battery causing moderate bodily injury and two counts of intimidation, all Level 6 felonies; and interference with the reporting of a crime and invasion of privacy, both Class A misdemeanors.

According to the probable cause affidavit filed Monday in Kosciusko Superior Court II, at 3:30 p.m. April 9 a 911 call to Kosciusko County Central dispatch came in  and the line had been left open.

Dispatchers reported they could hear lots of screaming, resulting in Winona Lake and Warsaw police responding to the residence.

Upon arrivals, officers located the homeowner, who told police he was in the kitchen on his computer when he heard an argument break out in a back bedroom between Potts and the female victim. The homeowner called police for help and said that when Potts became aware the man was on the phone with dispatch, Potts took his cellphone away and started punching him multiple times in the face.

The man told police he tried to get away from Potts, but Potts kept following him and punching him and threatened to kill him for calling the cops, according to court papers.

Police then spoke with the female victim, who told police she and Potts had gotten into an argument about Potts damaging the walls of the home and throwing things. The woman stated the verbal argument quickly became physical with Potts hitting her on the face and body. According to court papers, a juvenile child in the home then tried to jump in and protect the woman, to which Potts responded by saying he will kill her if she made a formal report against him and he gets arrested.

Potts was present when police arrived, and according to the affidavit, was in a state of being extremely upset and aggressive.

On Jan. 15, the Kosciusko County Sheriff’s Office served a protective order to Potts to stay away from the woman and the child involved in this incident.

Potts is also serving suspended sentences for convictions for resisting law enforcement, public intoxication and criminal trespass, along with being out on bond terms for charges of intimidation and disorderly conduct.

His bond was set at $6,000.
