Husband, wife arrested following confrontation over federal warrant

A husband and wife got taken to jail after allegedly intimidating and resisting law enforcement.

Mark A. Holbrook II, 42, of 920 Anchorage Road, #11, Warsaw, and Stacy A. Holbrook, 44, of 2605 10B Road, Bourbon, were booked in the Kosciusko County Jail Oct. 25.

Mark faces charges of intimidation on a law enforcement officer, a level 6 felony, and resisting law enforcement, a Class A misdemeanor. Stacy faces a level 6 felony charge of battery on a law enforcement officer.

According to the probable cause affidavit filed Thursday in Kosciusko Superior Court I, a Warsaw police officer arrived at Mark’s residence to serve an active federal warrant for his arrest. Mark then pulled away from the officer, yelled for his wife to come outside, then threw his cellphone to Stacy, court papers state. The officer tried to stop him, and the cellphone fell to the ground. While the officer was trying to hold Mark back, Stacy shoved the officer’s leg out of the way to try to reach the cellphone. The officer then threw Stacy to the ground, according to the probable cause affidavit.

“Mark Holbrook shoved the officer and then tried stepping on his phone in an attempt to destroy the evidence in it,” court papers state.

The officer obtained the phone and arrested Stacy. While arresting Mark, Mark told the officer he was “hit.” The officer stated he has prior knowledge of Mark being associated with the Aryan gang and has drug-dealing connections and asked Mark what that statement meant. Mark then asked if he was recorded saying that. The officer said a “hit” means to place a person in a harm and took the statement as a threat.

Mark had no bond set and is due in court at 8:15 a.m. Nov. 14 for an initial hearing.

Stacy’s bond was set at $5,250, and she’s expected to have an initial hearing at the same time.

Warsaw man faces charges after challenging officer to fight him

A man who allegedly has a history of provoking fights at bars got arrested for disorderly conduct after trying to fight a cop.

Nicholas S. Phillips, 35, of 1492 S. Wausau St., Warsaw, was booked in the Kosciusko County Jail at 7:19 p.m. Saturday for disorderly conduct, a Class B misdemeanor.

According to the probable cause affidavit filed Oct. 24 in Kosciusko Superior Court II, Warsaw police were dispatched to the Timeout, 1701 W. Lake St., Warsaw, in reference to a battery. Upon arrival, an officer spoke with Phillips who said he was punched on the left side of his face by a man inside the bar and that he wanted to press charges. The officer asked Phillips why the man punched him, and Phillips told police it doesn’t matter and that he wants to press charges, according to court papers.

A few days earlier, police responded to the Silver Inn in Silver Lake for a battery report that Phillips made, claiming the same type of situation occurred, according to the probable cause affidavit. When police asked him about the prior incident, Phillips said it was a different guy that hit him then, but that it started with an argument in the bathroom, just like the one at Timeout.

The officer went inside Timeout and spoke with other bar patrons and staff, who told police Phillips had been calling the man who punched him derogatory names and taunting him. A bartender at the Silver Inn also had told police she had to kick Phillips out several times over the last few weeks for starting fights, court papers state.

“I then said to Nicholas that it sounded to me like he was running his mouth and got punched for it on two separate occasions. Nicholas then got angry with me and told me to ‘take off that belt and see what happens.’ Nicholas then asked me, ‘Do you think you could beat my a**?’ Nicholas was attempting to get me to fight him as well, but I just informed Nicholas that he would just end up going to jail,” the police report states.

Phillips’ bond was set at $400.

Felony charges filed after pursuit

A man is facing several felonies for allegedly brandishing a pocketknife after leading police on a pursuit while he was drunk.

Caleb L. Roatcap, 28, of 3544 S. Palestine Lane, Warsaw, was booked in the Kosciusko County Jail at 1:04 a.m. Oct. 27 and faces charges of intimidation with a deadly weapon, a level 5 felony; resisting law enforcement, a level 6 felony; failure to stop after an accident, a Class B misdemeanor; and operating a vehicle while intoxicated, a Class C misdemeanor.

According to the probable cause affidavit filed Thursday in Kosciusko Superior Court III, a Warsaw officer on patrol on Oct. 26 observed a vehicle traveling faster than the posted speed limit and driving in a reckless manner. The officer activated his lights and attempted to pull the vehicle over, but the vehicle continued traveling at an excessive speed, resulting in a pursuit.

During the pursuit, according to court papers, the vehicle struck multiple street signs and continued to travel at a high rate of speed. Officers blocked the vehicle in and the vehicle began rocking back and forth, ramming the officers’ vehicles that were in front and back, causing damage to the patrol vehicles. Officers then used stop sticks to flatten the tires.

When officers approached the vehicle, Roatcap raised a pocket knife then waved the knife in a manner that communicated he would use it on any officer that attempted to get close to him, according to the probable cause affidavit. Roatcap then locked the doors.

Police broke the vehicle’s window and deployed stun guns into Roatcap. Officers then opened the door and forcibly remove Roatcap. Roatcap told police he was intoxicated, and results of a portable breathalyzer test determined his BAC was 0.129%, according to court records.

Roatcap was being held on a $10,250 bond and is due in court at 1 p.m. Nov. 14.
