    Notice is hereby given that the Kosciusko County Area Plan Commission will conduct a hearing on an application filed by Cornerstone Acres LLC, to amend the following restrictive covenants placed on the below described real estate through rezoning petition 16013Z;

Current Recorded Covenants in association to the rezoning of the property to Commercial

    1. The Real Estate shall not be used for any commercial purpose other than for sales, installation, and service of solar equipment, including a sales office, storage of inventory and equipment, interior parking of vehicles used in the business and such other activities solely related to the sales, installation and service of solar equipment.

    2. No exterior storage of any kind shall occur on the Real Estate.

    3. Ingress/egress shall only be from/to CR 1350 N.

    4. Only one structure shall be placed on the Real Estate, not exceeding 16,000 square feet (interior dimension).

    5. No residential use shall occur on the Real Estate.

    6. All exterior lighting shall be directed downward and shall not produce glare beyond the boundaries of the Real Estate.

    7. These covenants may only be amended with the consent of the Kosciusko County Area Plan Commission.

    8. These covenants shall be enforceable by the Kosciusko County Area Plan Commission.

Request Alterations to the Recorded Covenants:

    1. To allow the parking of business vehicles outside.

    2. To allow the installation of a security fence and gates 8’ tall with slats with the approval of the Board of Zoning Appeals for deviation from requirements of the Kosciusko County Zoning Ordinance on fencing.

    3. Allow more then one (1) structure associated to the solar business as limited to previously.

    4. To allow a solar energy system on site with the condition that it strictly complies with section 3.30 of the Kosciusko County Zoning Ordinance.

    The property is located at 8015 W 1350 N, Nappanee Key Number 023-004-001.

    And Described As Follows, To Wit:

    A tract of land in the northeast quarter of the southeast quarter of section 1, Township 34 North, Range 4 East, Scott Township, Kosciusko County, Indiana, more particularly described as follows:

    Beginning at a brass plug at the northeast corner of the southeast quarter of section section 1 and within the right-of-way of State Road 19; thence south 00 degrees 06 minutes 51 seconds east (basis of bearings established by INDOT VRS Base, using Indiana East NAD83 coordinate system), along the east line of said southeast quarter and within said right-of-way 1324.11 feet to the southeast corner of the northeast quarter of said southeast quarter;thence south 89 degrees 41 minutes 30 seconds west, along the south line of said northeast quarter, 1301.14 feet to a Kimpel cap pin at the southwest corner of said northeast quarter;thence north 00 degrees 05 minutes 02 seconds east, along the west line of said northeast quarter, 663.09 feet to a McCrea cap pin; thence north 89 degrees 38 minutes 46 seconds east, parallel with the north line of said southeast quarter, 660.00 feet to a McCrea cap pin; thence north 00 degrees 05 minutes 02 seconds east, parallel with said west line, 660.00 feet to a mag nail on said north line and within the right-of-way of County Road 1350 North; thence north 89 degrees 38 minutes 46 seconds east, along said north line and within said right-of-way, 636.57 to the point of beginning, containing 29.47 acres more or less.

    The Hearing will be held on February 6, 2019 at 1:00 p.m. in the Commissioners Meeting Room on the 3rd floor of the Courthouse, Warsaw Indiana 46580.  Written comments will be entertained by the Commission, if received in the Plan Commission Office no later than 12:00 (noon) on the day of the hearing.
