A South Bend man was arrested and two Fort Wayne residents are being sought in a theft case from November.

Thomas Bradley Maxwell Jr., 47, South Bend, was arrested and booked into the Kosciusko County Jail at 3:46 p.m. Tuesday for burglary. His bond was set at $21,000.

Court documents filed Dec. 17 list the charges against Maxwell as burglary, a level 4 felony, and theft, a level 6 felony. His bond was set at $20,000 surety and $1,000 cash.

Heather M. Dalton, Fort Wayne, is wanted on charges of burglary, a level 4 felony, and theft, a level 6 felony. Her bond is fixed at $20,000 surety and $1,000 cash.

Rocky D. O’Connell, Fort Wayne, is wanted on charges of burglary, a level 4 felony; theft, a level 6 felony; fraud on a financial institution, a level 5 felony; forgery, a level 6 felony; theft, a level 6 felony; and battery resulting in moderate bodily injury, a level 6 felony. His bond is fixed at $30,000 surety and $750 cash.

On Nov. 25, Kosciusko County Sheriff’s Office deputy Kevin Gelbaugh responded to a burglary at an unspecified location in the county. He spoke with the homeowner who said that sometime during November, unknown persons entered his residence and stole a flatscreen television, clothing, jewelry, DVD players, cable box and a Pioneer receiver, valued at over $750.

On Nov. 11, KCSO deputy Shawn Castillo had responded to a report of a stolen vehicle and the vehicle’s owner had been battered. The victim – Maxwell – told Castillo that O’Connell hit him over the head with something. Castillo saw that Maxwell had a bruise to his right eye. The right side of his head was injured and he had blood on his sweatshirt. Maxwell said O’Connell stole his 2016 Chevy Tahoe, which contained his wallet with his identifying information.

On Nov. 14, Castillo spoke with Maxwell, who said he found that on Nov. 12 about $500 had been stolen from his bank account without his permission. He said that since O’Connell had stolen his wallet when he stole the vehicle, O’Connell had used his information to withdraw the money without his consent.

KCSO Capt. Shane Bucher spoke with Maxwell, who admitted O’Connell, Dalton and he broke into a home, court documents state. O’Connell made entry into the residence and he saw O’Connell take the television off of the wall. He and O’Connell got into an argument and O’Connell beat him up, causing his injuries.

Dalton admitted to Bucher that O’Connell and Maxwell picked her up in Maxwell’s truck and there was already a television and other electronic items inside it. They then drove to a residence and O’Connell and Maxwell began fighting. She and O’Connell left in Maxwell’s Chevy Tahoe, and then she and O’Connell unloaded the stolen items at a woman’s home in New Paris.

Bucher found that Maxwell pawned a Pioneer receiver in Goshen. Bucher was able to identify the receiver as being stolen from the victim’s residence. A fingerprint on the receipt at the Goshen pawn shop was identified as O’Connell’s.

Using video from a bank, Bucher was able to determine O’Connell removed money from Maxwell’s banking account without Maxwell’s permission.

On Nov. 17, Elkhart County Sheriff’s deputies pulled over a vehicle and a male passenger identified himself as Maxwell with an Indiana ID card. Officers were able to determine that O’Connell used Maxwell’s identification to identify himself.

Bucher spoke with a woman who said O’Connell and Dalton came to her residence and unloaded a flatscreen television, stereo system and tools. She said O’Connell left a CD player at her residence and took the other items. The CD player was identified as a stolen item.
