Man Arrested After Breaking Into Couple’s Home While They Slept

Jose Cervantez, 21, of 16 Henderson Drive, Warsaw, was booked into the Kosciusko County Jail at 4:30 a.m. Monday for burglary. His bond was set at $30,000 surety and $750 cash.
Court documents filed Tuesday list the charges against him as burglary, a level 4 felony, and theft, a Class A misdemeanor.
On Monday, Warsaw Police Department officers responded to a burglary in Warsaw. Kosciusko County Central Dispatch advised officers that the suspect was inside the home.
Officers spoke with the homeowner, who said he woke up and heard someone outside his bedroom. He saw a man – later identified as Cervantez – standing in the doorway of his bedroom, shining a flashlight. Cervantez had the homeowner’s son’s Star Wars costume on. The homeowner asked Cervantez why he was in his home, and Cervantez turned and went down the stairs. The homeowner attempted to get Cervantez to go to the garage, but Cervantez never understood English, court documents state.
The homeowner said Cervantez removed the costume in the garage, then opened the homeowner’s wife’s vehicle and removed what he thought was a handgun with a silencer on it. Cervantez then walked away from the home, holding the gun in three fingers away from his body.
Officers used a K-9 to track Cervantez west of the residence and found him in a pickup truck parked on their lane. They identified him and found a black BB gun inside the pickup.
The homeowner’s wife told officers she found a blanket and Star Wars helmet inside her vehicle. The items came from inside the home, and the helmet was part of the costume that Cervantez had on inside the home.
WPD officer Brad Kellar spoke with Cervantez, who admitted that before he went inside the residence, he placed his BB gun inside the homeowner’s wife’s vehicle. He removed the blanket and helmet from inside the home and put them into the wife’s vehicle.
Officers searched Cervantez and in his pocket found a photograph of skiers at Hidden Lake and a small key.
