Akron Man Faces Drug, Child Pornography Charges

An Akron man arrested Thursday faces drug and child pornography charges after an overdose in March.

Andrew James Mitterling, 26, of 8719 W. CR 1250S, Akron, was arrested for possession of meth at 4:50 p.m. Thursday. His preliminary bond was set at $10,250.

Court documents filed April 11 list charges against Mitterling as possession of methamphetamine, a level 6 felony; possession of a narcotic drug, a level 6 felony; and child pornography, a level 6 felony.

On March 23, Kosciusko County Sheriff’s Department officer Christopher Anderson responded to a drug overdose at 8719 W. CR 1250S. He found emergency medical technicians treating the overdose victim, Mitterling, in the bathroom.

In the bathroom, officers found a round can containing a blue plastic bag of a rocklike substance and a black plastic bag containing an off-white substance. KCSD officer Joseph Mooney field-tested the rocklike substance and it tested positive for methamphetamine and weighed .08 gram. He also tested the off-white substance and it tested positive for heroin and weighed .02 gram. Officers also found a metal spoon with residue.

Officers confiscated Mitterling’s cellphone as evidence.

Mitterling admitted to Mooney he started using illegal drugs two weeks prior. He said he purchased the heroin and the methamphetamine around March 20. Mooney obtained consent to search Mitterling’s cellphone.

KCSD deputy Joshua Spangle searched Mitterling’s phone and found multiple images that depicted sexual conduct by a child who appeared to be less than 18 years old. Spangle also found images of bestiality and photos of children who appeared to be less than 12 years old. A sexual type of message about a 9-year-old girl also was found, according to court documents.

A court order for Mitterling’s arrest was issued April 11.
