Fairboard To Fight Racing Complaint

The complaint seeks an injunction to stop motorized racing at Warsaw Motorsports Complex, which is at the fairgrounds.
The statement said, “The fairgrounds is a 501c3 not-for-profit entity the receives no funding from the city or county. Our main source of revenue is fundraisers held by the fair board and volunteers. The Warsaw Motorsports Complex is a large portion of that revenue. With current capital projects and community programs, we are financially struggling. If we close the motorsports complex at the fairgrounds, our struggles will increase. We intend to conduct the events in a manner that is friendly toward our neighbors and the environment. We are planning to defend this lawsuit to keep our venue open and available for the community events.”
The fair board has started a GoFundMe account to help pay its anticipated legal fees. Contributions can be made at www.gofundme.com/fairgrounds-legal-defense-fund. As of late this morning, more than $1,500 had been raised toward a $100,000 goal.

The complaint was filed by Merle Conner, Judith Conner, Mary Clemens and Chris Cummins, all of Warsaw. They are seeking a temporary restraining order, preliminary injunctive relief and permanent injunctive relief against Kosciusko County Community Fair Inc. They seek a restraining order before the next races scheduled for May 11.
A hearing is scheduled for 2 p.m. Thursday in the Circuit Court.
Merle and Judith Conner also are listed as owners of a residence in Fort Wayne, according to the Allen County property tax website and Whitepages.com.
The Times-Union reached out to each of the plaintiffs for comment, but no calls were returned.
