FOR CERTAIN DISPOSABLE REAL ESTATE TRACTS
OF THE TOWN OF WINONA LAKE, INDIANA
Notice is hereby given that the Town of Winona Lake, Indiana is now soliciting bids for the Purchase of the following Real Estate, in whole or in part, beginning on the March 28, 2018 and continuing for sixty (60) days however, the disposing agent may sell the property to the highest and best bidder before expiration of the sixty (60) days, as per IC 36-1-11-4 , except that the property can be sold as the disposing agent determines at any time ten (10) days after the first publication.
In part, the disposable real estate is to facilitate compatible land use planning, and the Street and Sanitation Department structures need to be relocated to better serve the Town. The purchase must allow the Town Street and Sanitation Department to remain on the property for up to two years for the town to relocate for its Street and Sanitation Department, subject to negotiating if necessary; however there are some sanitation properties that must remain. The Solicitation of each the bidder shall provide its uses planned for the property, its development and its proposals with the bids all of which shall be considered by the disposing agent. Further the disposing agent may negotiate with the bidders. The disposing agent has the authority to reject all offers.
The property may not be sold to a person who is ineligible under IC 36-1-11-16] for delinquent taxes, special assessments, penalties, interest or costs directly attributable to a prior tax sales under IC 5-1.1-24-1.
A bid submitted by a trust (as defined in IC 30-4-1-1(a)) must identify each beneficiary of the trust; and each settlor empowered to revoke or modify the trust.
The disposable real estate that is the subject of this Solicitation is composed of various tracts, and the only address of the real estate identified herein, is the current address of the Street Department at 1631 Chestnut Street, Winona Lake, Indiana.
Pursuant to IC 5-3-4 the location of each property address, if any, or common description of the property other than legal description. The following paragraph is a statement, that briefly identifies the real estate just for informational purposes in layman's terms, but it is not a legal description. The Legal descriptions are set forth following after the following paragraph.
The Street Department of the Town of Winona Lake, Indiana. It is located at 1631 Chestnut Street, Winona Lake, Indiana. The land is in Winona Lake, Indiana. Chestnut Street bounded on the West lots, bounded on the Mineral Springs Avenue to the platted Pine Avenue South undeveloped road, with the land West to the Lagoon and also the East along lot 544 in the Winona Park Original Plat to the Line of an alley extended south to another addition on the south to another addition. Lots 37 to 41 of the 2 nd Additional Plat adjacent to Pine Avenue. Chestnut Street intersected on the North side of Columbia Drive South East to the section line and then extended North to Lot 41 and on to Pine Avenue.
The foregoing information is required by Indiana Law at IC 5-3-4.
The real estate that is the subject of this notice is described as follows, to-wit:
a.) A tract of land located in the State of Indiana, County of Kosciusko being a portion of Section 15, Township 32 North, Range 6 East, bounded on the West by Chestnut Street (Avenue) and more fully described as follows to-wit:
Commencing at the intersection of Chestnut Street (Avenue) and Mineral Springs street; thence South along the centerline of Chestnut street (Avenue) 342.19 feet to a point; thence East 20.0 feet to an iron pin and the place of beginning; thence East, 194.0 feet to an iron fence post; thence South 1 degree 33 minutes East, 307.4 feet to an iron pin; thence North 67 degrees 16 minutes West, 211.33 feet to an iron pin; thence North 1 degree 53 minutes West, 225.75 feet along the right of way line of Chestnut Street (Avenue) to the point of beginning, containing 1.18 acres of land more or less, which the deed to this property was signed on October 20, 1978 and was Recorded in the Office of the Recorder of Kosciusko County on June 7, 1979 and placed in Record No. 282 at Page 537.
a.1) As an explanation, the foregoing description was an earlier was about .73 of an acre lying north of the Lots 12,13,14,15,and part of Lot 16 and part of Lot 17. The .73 acreage part was used for the Street and Sanitation by the Town. The County Record showed as a separate parcel and that has not been changed; accordingly the County continues to list the Routing Number as 006-071-434.
However:
a. 2) For a long time the Lots, 12,13,14,15 and the parts of Lots 16 and 17, were being used and by the Town of Winona Lake, and the Winona Lake Christian Assembly, Inc. an Indiana Corporation had owned the .73 acre of land with the Routing Number as 006-071-434 and it also owned the above lots which were being used by the Town of Winona Lake, with a Routing number of 006-071- 299A and accordingly, the Winona Lake Christian Assembly, Inc. by issuing a Quit Claim Deed and its legal description combining to be both tracts to be 1.18 acres, which Deed was signed on October 20, 1928 and recorded the Deed in the office of the Auditor of Kosciusko County Indiana and the Recorder of Kosciusko County on June 29, 1979. These lots were intended to be combined but they are still listed by the County as separate parcels thus have not been combined on the record.
b. 3) Lots Numbered 12, 13, 14 and 15 of the 8th Amended and Additional Plat to Winona Park, were again deeded to the Town of Winona Lake, Indiana on November 22, 1991 and recorded in the office of the Recorder of Kosciusko County, Indiana on December 3, 1991, in Record 348 at Page 305 by Grace Schools, Inc, (as the recipient of the property of the Winona Lake Christian Assembly, Inc. as its ending) granted this deed to be sure that the above lots were included in and added to the deed that was signed on October 20, 1978 and recorded in the office of the Recorder of Kosciusko County, Indiana on June 7, 1979 in Record No. 282 at Page 537, as set forth in paragraph (a) above. (these lots extend to Columbia Drive).
b.) A Deed from Grace Schools, Inc. as Grantor and the Town of Winona Lake as the Grantee, was Recorded in the Office of the Recorder of Kosciusko County, Indiana on February 3, 1998, as Document Number 98-02-0091. This tract of land is approximately 4.83 Acres more or less and commences at an Iron Bar at the Northwest Corner of Lot Twenty-Three (23) in the 2nd Amended and Additional Plat to Winona Park; thence South 31 degrees East along the Southwest Line of Lots Twenty-Three (23) and Twenty-Four (24), 80 feet to an iron bar at the Southwest Corner of Lot Twenty-Four (24); thence Northeast, along the South line of said 2nd Amended and Additional Plat, 174.81 feet to an iron bar at the Southeast Corner of Lot 36 in said 2nd Amended and Additional Plat to Winona Park; thence North 31 degrees West 94.87 feet to an iron bar on the South line of Lot 40 in said 2nd Amended and Additional Plat; thence South along said South line, to 7.82 feet to an iron bar at the Southwest Corner of Lot 40; thence Northwest along the West line of Lot Forty (40), 83.80 feet to an iron bar at the Northwest Corner of said lot 40; and on the North Line of the Northwest Quarter; thence North 88 degrees 18 minutes 45 seconds East, along said North Line 151.19 feet to an iron bar; thence South, 604.59 feet to an iron bar; thence South 87 degrees 56 minutes 15 seconds East, 105.90 feet to the Southeast corner of Lot 544 in the Original Plat of Winona Park; thence North 02 degrees 03 minutes 45 seconds West, along the East Line of said original Plat of Winona Park, to the Northeast Corner of Lot 542 in the Original Plat of Winona Park; thence North 89 Degrees, 25 minutes 06 seconds East, along the on the Easterly projection of the north line of said Lot 542, 16.5 feet, more or less, thence South 02 degrees 3 minutes 45 seconds East along the West lines of Winona Lake land (recorded in Document 95-07-0337) along said East line to the East line of Lot Eighty-one (81) in the Fifth Amended and Additional Plat to Winona Park; thence Northerly and Northwesterly, along a curve to the left, along the Northeast Line of said Fifth Addition, 59.52 feet said curve having a radius of 142.50 feet and subtended by a chord 59.09 feet long bearing North 17 Degrees 58 minutes 34 Seconds West; thence continuing along said Northeast line of said Fifth Addition North 33 degrees 07 minutes 39 seconds West (North 32 Degrees 06 minutes 30 Seconds West Recorded), 945.84 feet to the Northeast Corner of Lot Sixty (60) in said Fifth Amended and Additional Plat; thence North 58 Degrees 48 minutes 15 Seconds East, 109.55 Feet to the point of beginning. This deed by setting forth the 2.42 acres portion that has not been developed, and that Lot 38 of the 2nd Amended and Addl Plat to Winona Park, consisted of 9/10 of an acre, Parcel ID 006-110-013, and Lots 37, 39 & 40 2nd Amend & Add PL to Winona Park consisting of .21 acres, Parcel ID 006-110-114.
c.) This following deed was signed on June 25, 1993 by Grace Schools, Inc. an Indiana Corporation, and conveyed by Grace Schools, Inc., an Indiana Corporation, as the Grantor to the Town of Winona Lake Indiana as Grantee, and which deed was recorded on June 29, 1993 as Document Number 93-06-1725 in the Office of the Recorder of Kosciusko County which deed conveyed about 3.92 Acres more or less in the SW Quarter of Section 15, Township 32 N, Range 6 E, in the Town of Winona Lake, Indiana, including, but not limited to, the land lying East of Chestnut Street, and lying South of Mineral Springs Ave., and being bordered on the East by the West line of Pine Avenue, and thence North lot lines numbered 39,40,41,42 through to 19 at its intersection with the north line of Columbia Drive where it to the West and along Columbia Drive less the Real Estate set forth at paragraphs (a) (a-1) and (b) hereinabove, more particularly described as follows:
Commencing at the intersection of the centerlines of Chestnut Avenue and Mineral Springs Avenue; thence South 01 degrees 47 minutes 59 seconds East, along the centerline of said Chestnut Avenue, 342.28 feet (South, 342.19 feet recorded on an adjacent tract deed); thence North 90 degrees 00 minutes 00 seconds East, 20.00 feet to a hole drilled in the concrete sidewalk, said point being the Point of Beginning; thence North 01 degree 47 minutes 59 seconds West, along the East line of Chestnut Avenue, 306.40 feet to a 1/2 inch iron bar at the intersection of the East line of Chestnut Avenue and the Southwest line of Mineral Springs Avenue; thence South 51 degrees 37 minutes 39 seconds East, along said Southwest line of Mineral Springs Avenue, 807.94 feet to a 1/2 inch iron bar on the West line of Pine Avenue; thence South 01 degree 53 minutes 15 seconds East, 120.81 feet to a 1/2 inch iron bar; thence South 88 degrees 18 minutes 45 seconds West, 381.08 feet to a 1/2 inch iron bar on the Northwest line of Columbia Drive in the Second Amended and Addition Plat to Winona Park, now the incorporated Town of Winona Lake; thence Northwesterly, along said Columbia Drive and along a curve to the left, 43.89 feet to a 1/2 inch iron bar, said curve having a radius of 200 feet and subtended by a chord 43.80 feet long bearing North 62 degrees 37 minutes 23 seconds West; thence North 01 Degree 29 minutes 05 seconds West (North 01 degree 33 minutes West recorded on adjacent deed), 307.40 feet to an iron fence post; thence South 90 degrees 00 minutes 00 seconds West, 194 feet to the point of beginning. Said tract contains Lot 18 and parts of Lots 17 and 16 in the Eighth Amended and Additional Plat to Winona Park, now the incorporated Town of Winona Lake, Indiana.
d.) Lot Numbered 41 in the 2nd Amd and Add Winona Park, now in the Town of Winona Lake, Indiana, was conveyed by the Board of Commissioners of Kosciusko County, Indiana which Deed was Recorded on April 27, 2017 in the Office of the Recorder of Kosciusko County, Indiana, Document Number 2017-04-0983 also addressed as Book Number is 201704 Page 0983 and consisting of .09 acres Parcel ID 006-110-115.
All of the Land above is Subject to all Covenants, Conditions, Easements, Restrictions, Greenways, Mortgages of Record and all Applicable Building, Zoning Ordinances and Laws and Possible Rights of Title and Drainage Ditches.
The bids and proposals will be received and be open and available to any other bidder. Any bidder shall be entitled to know the offer that is made. Any bidder shall have the right to know the amount of its competition. The Bids will be delivered to the Winona Lake Town Hall, located at 1310 Park Avenue, Winona Lake, Indiana, to Craig Allebach, Town Manager.
Any person may appear and be heard. Any written comments and statements upon the matter can be presented to the Office of the Clerk-Treasurer of the Town before the hearing and will be considered during the hearing. Written comments and statements may also be presented at the meeting.
