LEGAL NOTICE FOR RULE 5 FOR

BELLE AUGUSTA – SECTIONS 3 & 4

    In according with the requirements of 327 IAC 15-5-5(Rule 5) a Notice of Intent (NOI) for Storm Water Discharges Associated with Construction Activity is being submitted by Biggs Indiana Properties LLC to the Indiana Department of Environmental Management. The project is a continuation of the residential community named BELLE AUGUSTA. Section 3 includes lots 40 through 62, which are planned as single family lots. All site development is proposed for these lots in the spring and summer of 2018. Lots 41 through 77 are to be cleared and right graded for future utilities and paving as part of the Section 3 2018 project. And the future utilities, final earthwork and paving of Section 4 is included in the NOI being submitted at this time. The project is generally located about 3 tenths of a mile north of Old US Highway 30, 700’ EAST OF COUNTY ROAD 225 EAST at the end of the recently constructed MITCHELL’S BOULEVARD in Warsaw, Indiana. It is specifically located in part of the Southwest Quarter of Section 11, Township 32 North and Range 6 East, in Wayne Civil Township of Kosciusko County.  Construction Activities will commence within 30 days of this notice and last approximately until the April of 2023, including the proposed individual home building. The storm water from the site will infiltrate to the sandy soils underlying the property. No storm sewer outlet is proposed from the project. The project is located in the Deeds Creek watershed which drains through Pike Lake, continuing downstream to the Tippecanoe River, Wabash River, Ohio, and Mississippi Rivers, which outlets to Gulf of Mexico.
