Moore, Futymoski Have Initial Hearings In Court

The woman facing a felony count of neglect of a dependent after her 2-month-old infant died Oct. 30 had her initial hearing this morning.

Marissa Jean Moore, 20, of 810 Charles Drive, Winona Lake, faces up to 1-1/2 to 2-1/2 years in jail and up to a $10,000 fine.

She asked Superior Court I Judge David Cates for a court-appointed attorney today, stating she was not employed, had no personal income, only a few dollars in a savings account and all her money comes from her fiance. She did own her own vehicle.

Moore’s final pretrial conference was set for 8:30 a.m. Feb. 28.

According to court documents, on Oct. 30 a Kosciusko County Sheriff’s Department officer responded to a call of an unresponsive infant at 4330 N. Old 15. When the officer arrived, medical personnel were providing medical attention to the infant, whose father was identified as Steven Brown.

The child, Elena Lanae Moore, was taken to Kosciusko Community Hospital, where she was pronounced dead.

Brown and Moore told the officer they were sleeping in the same bed as the infant and woke up to find her unresponsive, according to court documents. Officers investigated the area where the girl was lying and found a bottle that had the nipple cut to make it bigger. The bottle contained formula mixed with cereal in a thick paste.

Another initial hearing before Cates this morning was for Andrew James Futymoski, 28, of Schoolcraft, Mich.

According to a probable cause affidavit, the eight charges against him include four counts of burglary, all level 5 felonies; three counts of theft, Class A misdemeanors; and theft, a level 6 felony.

For each of the level 5 felonies, he could face one to six years in jail and a fine of up to $10,000; for the level 6 felony, he could face 1-1/2 to 2-1/2 years in jail and a fine of up to $10,000; and for the Class A misdemeanor, he could face up to a year in jail and a fine of up to $5,000.

Futymoski requested and was granted a court-appointed attorney.

His final pretrial conference will be at 8:30 a.m. March 26.

On Oct. 10, Kosciusko County Sheriff’s Department officer Jon Tyler responded to a burglary, theft and criminal mischief at Packrat Storage. Upon arrival, he spoke with a woman who said unknown suspects cut the lock on her storage unit.

She said she could find no items missing. The officer checked the other units and found numerous locks had been cut off of unit doors.

On Oct. 7, Ligonier Police Department officer Brandon Stout conducted a traffic stop and identified the occupants as Futymoski and Christina Swinehart. The occupants admitted to stealing property out of storage units in Kosciusko County.

Swinehart was arrested on a burglary charge on Dec. 29.
