A request to vacate an undeveloped right of way near Beaver Dam Lake was turned down Tuesday by the Kosciusko County Commissioners.

The sparsely used alley runs parallel between Upper Bensart Drive and Bensart Drive on the east side of Beaver Dam Lake.

A group of neighbors had sought to have the right of way of an alley vacated, but ran into opposition when they made their request before the county’s Area Plan Commission on Jan. 2.

The alley serves as an access point for utilities and emergency responder vehicles, according to Plan Director Dan Richard.

The plan commission opposed the request.

On Tuesday, the commissioners unanimously supported the plan commission recommendation on the request.

However, in doing so, commissioner  Brad Jackson asked that an encroachment agreement be approved because a septic system that was recently installed encroaches in the right of way.

Petitioners included Gary Klein, Richard Nelson and Jaque Hayes.

In other matters, the commissioners approved the purchase of a new dump truck for the highway department.

With trade-in, the 2019 Western Star dump truck with  tandem axel will cost $172,943. The winning bid came from Trans Chicago Group, Gary.

Extras included hydraulics, underbody scraper, front plow and a tailgate spreader.

The bid was one of three received by the county, according to Scott Tilden, county highway superintendent.
