Plymouth Man Arrested After Making Threats At Gas Station

A man with a history of run-ins with the cops was arrested Friday after allegedly making threats to a female relative and people inside a local gas station.

Gene Poe, 33, Plymouth, was arrested and booked into the Kosciusko County Jail at 1:23 p.m. Friday on charges of intimidation with a deadly weapon; battery with a deadly weapon; and criminal confinement. His preliminary bond was set at $25,250.

According to information from the Kosciusko County Sheriff’s Department, at approximately 12:11 p.m. Friday police received a report of an unwanted person with a knife who was threatening to kill everyone inside the gas station at 2535 E. U.S. 30, Warsaw.

Upon arrival, county deputy Kreg Kuhn entered the station with his firearm in a low ready position. He immediately recognized Poe as Poe retrieved a knife from his pocket. Kuhn ordered Poe to drop it.

Poe threw the knife away from Kuhn, who then told Poe to put his hands behind his back. Instead, Poe flailed his hands as if he wanted to fight and took steps toward Kuhn in an aggressive manner, according to the KCSD report.

Kuhn then holstered his firearm and grabbed the arms of Poe in an attempt to place him into hand restraints.

Upon doing so, Poe began to pull away from Kuhn’s grip and strike him with his elbows and arms. After Poe continued to physically resist, Kuhn threw Poe to the ground in an attempt to stop the altercation. Once on the ground, Poe continued to resist by striking Kuhn with his hands. Other officers then arrived and assisted Kuhn in detaining Poe.

As officers attempted to gain control of Poe’s hands, he continued to strike officers with his hands and didn’t obey commands to display his hands. Kuhn told Poe to stop resisting or he would be tased. Poe ignored Kuhn’s commands and continued fighting. Kuhn then used his stun gun on Poe’s leg, but it had no effect on Poe who was then able to grab the stun gun from Kuhn’s grasp.

After Poe gained possession of the Taser, Kuhn held the power switch to the off position until he could pull the Taser back from Poe. Shortly after, the report states, responding officers were able to gain control of his hands and take him into custody.

Poe was then taken to the jail as Kuhn spoke to Poe’s female relative.

The relative said Poe lives with her and that he recently became very irritable and threatened to kill her. Poe and the woman then drove to the gas station with Poe holding a utility knife to her side, the report said.

Once at the store, Poe armed himself with a large flashlight and the knife as they walked from the car to the store. While walking through the parking lot, the relative said she did not feel as if she had the right to leave Poe. He also allegedly told her, “If you do one thing wrong I’ll gut you right there in front of everybody.”

Once inside the station, the woman said she had to use the restroom, started heading that way and then mouthed “call the cops” to a gas station employee.

The worker then distracted Poe so the woman could get to the restroom and lock herself inside.

Police were notified and responded shortly thereafter, the report said.

According to Kosciusko County Sheriff’s Department Lt. Don Wiesehan Jr., “He’s been in treatment programs before,” adding that Poe has been arrested on previous occasions.

Along with KCSD, officers from Winona Lake and Warsaw police departments arrived to the scene.
