Kosciusko County Superior Court I Judge David Cates accepted the plea agreement for Nathan J. Dollar, 19, on a level 5 felony charge of conspiracy to commit intimidation. A level 3 felony charge of conspiracy to commit robbery was dismissed.
Dollar was sentenced to three years in the Indiana Department of Corrections, but two years were suspended for probation. The execution of his sentence may be served through Kosciusko County Community Corrections (KCCC), if he qualifies for and maintains his qualification for it. He has until 4 p.m. Dec. 28 to be “hooked up” with KCCC, Cates said, or he must turn himself in to the county sheriff at that time to be taken to the DOC.
Dollar earned three days of jail time credit, and must have no contact with his victim. Dollar must maintain gainful employment and pay $300 to the county for his appointed legal counsel.
This was Dollar’s first felony conviction, though Cates acknowledged it wasn’t the first time he had gotten into trouble.
“I hope you have substantially changed,” Cates told Dollar.
Dollar pleaded guilty to the conspiracy charge in November.
According to a Warsaw Police Department press release issued in November 2017 and a probable cause affidavit filed with the courts in December 2017, a witness called police on Oct. 31, 2017, and said three men jumped out of a car with guns in the 400 block of South Columbia Street. They then got back into the vehicle.
Police found the vehicle around the 1900 block of East Center Street and made a traffic stop. Dollar was driving the vehicle and two other men were passengers. Police found an assault rifle, tire iron and crowbar in the vehicle along with drug paraphernalia and marijuana.
After interviewing the men, police determined the men had intended to commit a robbery in the vicinity.
In the courtroom Thursday morning, Chief Deputy Prosecuting Attorney Brad Voelz said the victim in the case requested no restitution. He said this case was part of another where there was a total of seven co-defendants and Dollar was the last to be sentenced. Voelz reminded Cates that another defendant in the cases, Nathan Ries, 18, of Syracuse, was sentenced last Thursday to 18 years in prison.
Voelz said defendants who cooperated in the case told him that Dollar was more involved than he would have them believe.
Jack Birch, Dollar’s court-appointed attorney, said he didn’t know what actually happened other than what he read in the police reports. However, he said the Nathan Dollar he first met is not the Nathan Dollar now.
“I think Nathan was caught up in the gangster idea and he thought that was cool,” Birch said. He said reality caught up to Dollar and he’s since changed substantially. “I don’t think he’ll be back in this situation in the future. He knows what he did is beyond stupid.”
Cates offered Dollar a chance to make a statement, but he declined.
