COMES NOW the Plaintiff, U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for REO Trust 2017-RPL1 (“U.S. Bank”), by counsel, having filed its Complaint and Affidavit in the above-entitled cause, hereby requests that the Clerk of Kosciusko Circuit/Superior Court, issue the Summons by publication as follows:
1. This Summons by publication is specifically directed to Defendant, The Unknown Heirs of Jackie S. Shafer, Deceased, whose last known address(es) and his/her present address(es) is/are unknown.
2. The nature of the above-captioned cause is that on July 23, 2003, Jackie S. Shafer executed and delivered to U.S. Bank a certain Loan Repayment and Security Agreement (the “Note”) by which she promised to pay to the order of U.S. Bank the sum of $88,420.07, together with interest and as of December 4, 2018, there is a principal balance owing in the amount of $58,927.90.
3. To secure payment of the Note, Jackie S. Shafer executed and delivered to U.S. Bank a Mortgage upon certain real estate (the “Mortgage”), said Mortgage being executed on July 23, 2003. The real estate, which is the subject matter of this cause, is described as follows, to-wit:
THE FOLLOWING DESCRIBED REAL ESTATE IN KOSCIUSKO COUNTY IN THE STATE OF INDIANA, TO-WIT: THE SOUTH 50 FEET OF LOTS NUMBERED 123 AND 124 IN WILLIAM’S ADDITION TO THE TOWN, NOW CITY OF WARSAW, KOSCIUSKO COUNTY, INDIANA. TAX MAP OR PARCEL ID NO.: 04-707012-70,
More commonly known as 115 North Sherman Street, Warsaw, Indiana 46580,
Parcel No. 43-11-09-300-669.000-032,
(the “Real Estate”).
4. U.S. Bank, as the holder of the Note and assignee of the Mortgage, has accelerated the entire balance due and owing on the Note and Mortgage, due to Jackie S. Shafer’s failure to make the required payments and is also responsible for prejudgment interest as set forth in the Note and reasonable attorney fees.
5. The Defendant, The Unknown Heirs of Jackie S. Shafer, Deceased, named herein must answer this Summons in writing, personally or by counsel, on or before thirty (30) days from the date of the third publication hereof. If said Defendant fails to do so, judgment may be rendered against him/her for the relief demanded.
