LEESBURG – A tenant might have gotten away with stealing from his landlord if the landlord hadn’t installed trail cameras.
Marc Kyle Sutherland Sr., 43, of 23 EMS T26C Lane, Leesburg, was arrested and booked into the Kosciusko County Jail at 2:55 p.m. Wednesday for burglary of a dwelling. His preliminary bond was set at $21,500.
Court documents filed April 20 list the charges against him as burglary, a level 4 felony; theft, a Class A misdemeanor; auto theft, a level 6 felony; and theft, a level 6 felony.
On Jan. 2, Syracuse Police Department officer Joseph Denton responded to a burglary and theft complaint. Upon arrival, he spoke with a man who said Marc Sutherland and his wife rented an apartment above his residence. He said on Jan. 2 he left for work, and when he returned at about 2:30 p.m., he noticed someone had entered his residence without his permission and stole two $100 bills from his bedroom.

He said he had installed a camera, and when he checked, he saw Sutherland had entered the apartment. The landlord showed the photographs from the camera to Denton who was able to identify Sutherland as the person entering the residence.
The landlord said he spoke with Sutherland’s wife and she allegedly told him that Sutherland used a credit card to open the door to his residence and they would pay the money back. She then gave him $200.
He later found Sutherland also had stolen a new cell phone valued at $400 and about $100 in change.
On March 6, Denton returned to the residence regarding a title check on a motorcycle. Upon arrival, Denton checked the vehicle identification number on a 2001 Bourget Kruzer motorcycle and found the motorcycle was reported stolen on April 20, 2017, to Rusk Police Department in Rusk, Texas, by the owner. Denton obtained the case report from Rusk and found the suspect in the theft of the motorcycle was Sutherland. The motorcycle owner said Sutherland took his motorcycle to work on it and never returned it, the report said.
The landlord said he had traded his motorcycle and $1,000 to Marc Sutherland for the other motorcycle. He said Sutherland told him he had lost the title.
On March 23, SPD officer Michael Bumbaugh responded to the landlord’s residence and spoke with the landlord, who said he had evicted the Sutherlands. Afterward, he discovered they had apparently stolen 10 Bose double speakers, a leather Harley Davidson jacket, RCA DVD player and an autographed and authenticated Michael Jackson photograph. Total value of the stolen items is about $1,260. The victim said the stolen items had been stored in the rental apartment in a room.
