Residential Entry Plea Brings Less-Than-One-Year Sentence

The man arrested in February in connection to a January arson in Syracuse will serve less than a year in the Kosciusko County Jail after being sentenced this morning in Kosciusko County Superior Court I.

As part of a plea agreement, Travys Lee Hise, 20, of 10018 N. Mulberry Drive, Syracuse, pleaded guilty to residential entry, a level 6 felony. The charge carries up to 2-1/2 years in jail and a fine of up to $10,000.

Court documents filed Feb. 5 listed the original counts against Hise as burglary, a level 4 felony; arson, a level 4 felony; and theft, a Class A misdemeanor. Those were dismissed as part of the plea agreement.

Judge pro tem Benjamin Vanderpool sentenced Hise to one year in jail, with credit for time served (78 days) and good behavior. He allowed Hise to serve his time through the Community Corrections program. Hise must pay $300 for legal counsel that was appointed to him and help make restitution for the arson victim’s home of over $273,000.

Chief Deputy Prosecutor Brad Voelz told Vanderpool that the reason the plea agreement was offered to Hise was because on Jan. 30 Hise and a 17-year-old juvenile broke into Steven Kelly’s residence at 10322 N. Grand Blvd., Syracuse, and the house was set on fire.

After further investigation and a trial it was determined that Hise did not know the juvenile had intended to set a fire.

Voelz said Hise was being charged with the crime he did commit and Hise has accepted that.

Jay Rigdon, Hise’s attorney, told Vanderpool that Hise was accepted into the Community Corrections program. He recommended the judge sentence Hise to a year in jail with access to the program and be given credit for the time he’s already served. Hise was still serving time in jail as of today.

On Jan. 30, Turkey Creek Fire Department responded to a house fire belonging to Kelly, according to court documents filed in February.

A news release issued by the fire department after the fire gave the address as 10322 N. Grand Blvd., Syracuse, and said it responded to the call at about 1:50 p.m. The release also stated the home was owned by KRE Assets LLC, 1 Industrial Drive, Cromwell. The fire territory determined the house was a total loss, with damage estimated at over $90,000.

According to court documents, the fire department determined the house fire had been intentionally set.

Kosciusko County Sheriff’s  officer Kevin Gelbaugh spoke with nearby construction workers who said they saw two men walking toward the residence shortly before the fire. Gelbaugh found the two men walking on East Morrison Island Road near the house fire. He identified one man as Hise. Court documents did not identity the other man.

Hise told Gelbaugh that he and the other man broke into the residence, according to the court documents. Hise said the other man used a lighter found inside the residence to set the fire.

Hise admitted to vandalizing the residence.
