Battery Charges Filed In March Incident That Put Man In Hospital

Daniel Ybarra, 34, of 2070 E. CR 800S, Claypool, was arrested and booked into the Kosciusko County Jail at 8:05 p.m. Saturday for probation violation – felony and battery with a deadly weapon. His preliminary bond was set at $27,500.
Court documents filed March 13 list the charges again him as battery while armed with a deadly weapon causing serious bodily injury, a level 5 felony; battery, a Class A misdemeanor; and criminal mischief, a Class B misdemeanor.
On March 1, a woman reported to Kosciusko County Sheriff’s Deputy Chris Anderson that her son had been battered at his residence. She told

Anderson that her son had been knocked unconscious and was taken by a neighbor to Parkview Hospital Warsaw. Her son was then transferred to Parkview in Fort Wayne where he required surgery for his injuries.
On March 7, KCSD deputy Shane Bucher met with the son and his girlfriend. The son said he was cleaning his house when he heard a noise like something broke on the porch. As he stepped outside and discovered his porch light was broken, he was hit and knocked to the ground by Ybarra. He also said he was hit several times by Ybarra until he lost consciousness. When he regained consciousness, he walked to the home of a relative who took him to the hospital.
Parkview Hospital staff determined the victim had bilateral fractures and a nasal bone fracture. The injury to his jaw required it to be wired shut.
Bucher spoke with the girlfriend who said she saw Ybarra break the porch light and then saw Ybarra tackle the victim.
Ybarra has a previous conviction for criminal mischief on April 29, 2009, in Kosciusko County Superior Court II and a previous conviction for battery on March 17, 2010, in Wabash County Superior Court, according to court documents.
A motive behind the alleged attack was not detailed in the court document.
