Bank suspect gets 4-year term

A third charge of theft was dismissed as part of Montileaux’s plea agreement with the Kosciusko County Prosecutor’s Office.
Circuit Court Judge Michael Reed found Montileaux, 38, of Mentone, guilty of robbery, a level 5 felony, and failure to appear, a level 6 felony. For the robbery charge, he was given three years in the IDOC and another year for the failure to appear. Charges are to be served consecutively.
Reed also gave Montileaux 114 days for credit served, but Montileaux, through his attorney, Joseph A. Sobek, said he thought that amount should be larger because he’s already served nine months in jail. Reed said Montileaux had also been serving time in jail on another charge, but his credit for time served would be reviewed and he would get the proper amount of credit for time served.

When Reed asked Montileaux if he had anything to say before sentencing him, Montileaux responded, “I deserve whatever you give me.”
On March 8, 2017, Kosciusko County Sheriff’s Department deputy Michael Mulligan and Mentone Town Marshal Jim Eads responded to a bank robbery at Lake City Bank, according to court documents.
Officers spoke with the LCB manager who said she saw and heard a man tell a teller, “I don’t want (marked) money” and she knew the man – later identified as Montileaux – was attempting to rob the bank. The manager saw Montileaux leave the bank and walk northwest. She went outside and saw him go into a residence at 211 N. Tucker St., Mentone. She called Eads and told him the bank had been robbed and described where he went.
Eads and KCSD deputy Don McCune went to the residence and the door was answered by Montileaux’s sister who said he was inside and gave officers consent to search the house. Montileaux and the stolen money were found inside.
The tellers gave Montileaux more than $750 in cash.
The LCB manager identified Montileaux as the robber. Officers also obtained the surveillance video and were able to identify Montileaux as the robbery suspect.
Prosecutor Dan Hampton asked for Montileaux to pay for extradition costs of $593.61 by the Kosciusko County Sheriff’s Department, and Reed granted that request as part of his order.
Reed also ordered for Montileaux to get treatment for substance abuse while at the IDOC.
