NOTICE OF PUBLIC HEARING NAPPANEE CITY PLAN COMMISSION

    The City of Nappanee Plan Commission will hold a Public Hearing Thursday, November 9, 2017 at 7:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.

    The purpose of this Hearing is to conduct a Public Hearing on Petition #02-17-PLN filed by B. Doriot & Associates Inc. PO Box 465 New Paris, IN 46553 for owners Air Investments, LLC 23965 U.S. 6 Nappanee, IN 46550.                                  The petitioner is requesting approval of a 1 lot Subdivision known as Air Investments Subdivision Lot 1.

    Legal Description of Property:  

    A part of the Southeast Quarter of Section 31, Township 35 North, Range 5 East, Union Township, Elkhart County, Indiana, more particularly described as follows:

    Commencing at the Northeast corner of said Southeast Quarter of Section 31; thence South 00 degrees 03 minutes 00 seconds West (Record Bearing Deed Record 2009-28145), along the East line of said Southeast Quarter of Section 31, a distance of 719.95 feet; thence North 89 degrees 53 minutes 00 seconds West, a distance of 250.36 feet to the POINT OF BEGINNING of this description; thence continuing North 89 degrees 53 minutes 00 seconds West, a distance of 281.51 feet; thence South 00 degrees 03 minutes 00 seconds West, parallel with said East line of the Southeast Quarter of Section 31, a distance of 20.00 feet; thence North 89 degrees 53 minutes 00 seconds West a distance of 720.37 feet; thence South 00 degrees 19 minutes 09 seconds East,  a distance of 241.06 feet to a point on the North line of the former B & O  Railroad; thence South 83 degrees 55 minutes 00 seconds East along said North line of the former B & O Railroad, a distance of 722 .83 feet; thence South 83 degrees 37 minutes 25 seconds East, along said North line of the former B & O Railroad a distance of 283.23 feet; thence North 00 degrees 03 minutes 00 seconds East, parallel with said East line of the Southeast Quarter of Section 31, a distance of 367.07 feet to the POINT OF BEGINNING; said above described tract contains 6.87 acres more or less.

    Subject to all easements, restriction, drain tiles, public highways and right of way of record.

    A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered.

    All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.

    Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the City should contact the Office of the City Clerk-Treasurer, 300 West Lincoln Street, Nappanee, Indiana 46550, (574)773-2112, [email protected] as soon as possible but no later than 48 hours before the scheduled event.
