NAPPANEE CITY PLAN COMMISSION

    The City of Nappanee Plan Commission will hold a Public Hearing Thursday, July 13, 2017 at 7:00 p.m. in the Council Chambers at the Nappanee City Municipal Center, 300 W. Lincoln St., Nappanee, Indiana. The purpose of this hearing is to hear the following rezoning request filed by the owner Dutch Country Holdings, LLC by and through its duly authorized agent, Abonmarche, 1009 South Ninth Street, Goshen, IN 46526. The said property is located off of Tomahawk Trail, south of Berlin Court Ditch containing 77.80 acres more or less.

    Petition: Change the zoning from R-1, Low Density Residential to B-2 General  Business with respect to the following described real estate, to wit:

LEGAL DESCRIPTION OF PROPERTY:  

REAL ESTATE

    Part of the Southwest Quarter of Section 26, Township 35 North, Range 4 East, Locke Township, Elkhart County, Indiana, described as follows:

    Beginning at the Southwest corner of the Southwest Quarter of said Section 26, marked with a corner stone; thence North 00 degrees 14 minutes 11 seconds East (a record bearing along the North line of the Quarter section is the basis for bearings), along the West line of said Southwest Quarter, a distance of 1885.57 feet to a capped 5/8 inch reinforcing rod on the South top of bank of the Berlin Court Ditch; thence continuing North 00 degrees 14 minutes 11 seconds East, along said West line, 35.00 feet to the center of said Ditch, said point being situated South 00 degrees 14 minutes 11 seconds West 725.50 feet from the Northwest corner of said Southwest Quarter; thence along the centerline of said Berlin Court Ditch with the following six  (6) courses: South 53 degrees 45 minutes 05 seconds East 129.29 feet; thence South 75 degrees 55 minutes 27 seconds East 324.94 feet; thence South 76 degrees 57 minutes 00 seconds East 214.32 feet; thence South 67 degrees 04 minutes 03 seconds East 315.95 feet; thence South  78  degrees 57 minutes 49 seconds East 347.56  feet;  thence South 79 degrees 14 minutes 23 seconds East 1402.14 feet to an intersection of said Ditch centerline with the East line of Southwest Quarter, and being marked with a “MAG” nail; thence South 00 degrees 09 minutes 00 seconds West, along said East line, 613.60 feet to a  railroad spike marking the Northeast corner of lands previously conveyed as Tract 1, by Deed Record 2012, page 01029; thence North 89 degrees 53 minutes 19 seconds West, along the North line  of  said Tract 1, a distance of 850.00 feet to a capped 5/8 inch reinforcing rod; thence South 00 degrees 09 minutes 00 seconds West, along the West line of Tract 1 and the West line of Tract 2 as previously conveyed by Deed Record 2012, page 01029, a distance of 656.80 feet to a capped 5/8  inch reinforcing rod  on the South line of said Southwest Quarter; thence North 89 degrees 53 minutes 19 seconds West, along said South line, 1792.43 feet to the point of beginning, containing 80.80 acres, more or less.

    Less and excepting from the above described tract the following, to-wit:

    Part of the Southwest Quarter of Section 26, Township 35 North, Range 4 East, Locke Township, Elkhart County, Indiana, more particularly described as follows:

    Commencing at the Southeast corner of the Southwest Quarter (SW 1/4) aforesaid, and running North (assumed) on the Centerline of County Road No. 101 which is also the East line of said Southwest Quarter (SW1/4), a distance of 666.8 feet to a PK nail, which is the true beginning point of this tract; thence West 522.71836 feet; thence North 250 feet; thence East 522.71836 feet to the Centerline of County Road No. 101 which is also the East line of the Southwest Quarter (SW 1/4); thence South 250 feet to the Point of Beginning, containing 3.0 acres, more or less.

    Above description taken from Instrument #89 010635 as recorded in the Office of the Recorder of Elkhart County, Indiana. The above described parcel being a previously annexed parcel located within the Civil City of Nappanee, Indiana.

    The above described tract, after exception, containing 77.80 acres, more or less.

    A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered.

     All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.     

     Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the City should contact the Office of the City Clerk-Treasurer, 300 West Lincoln Street, Nappanee, Indiana 46550, (574)773-2112, [email protected] as soon as possible but no later than 48 hours before the scheduled event.
