Warsaw Incident Proves Fatal For South Bend Man

A South Bend man died after a Winona Lake man allegedly drove over him multiple times with his car following an alleged drug deal gone bad.
Police responded to a report of a car hitting a pedestrian at 9:30 p.m. Friday  on North Cook Street, Warsaw, Friday night.
Emergency responders were called to the scene and found Derek Davidson, 29, South Bend, trapped under a car. Warsaw-Wayne Fire Territory extricated Davidson and he was transported to Kosciusko Community Hospital where he died from his injuries.
Police arrested Daniel Duenas, 18, of 2326 E. Pierceton Road, Winona Lake, and Davidson’s brother-in law, Jarred Miller, 19, of 521 N. Colfax St., Warsaw, in connection with the incident.
Duenas is being in held in Kosciusko County Jail on charges of voluntary manslaughter.
Miller is behind bars for his involvement in the alleged drug deal. Miller also is being held on charges of robbery and resisting law enforcement. Both men are on a prosecutorial hold  awaiting results of an autopsy and investigative reports before formal charges are filed.
According to a news release from Warsaw Police Department, Duenas was going to buy marijuana from Miller and Davidson, when the two men battered Duenas and robbed him. Police allege Duenas backed his car into Davidson and ran him over multiple times, pining Davidson under the car.
Duenas fled the scene on foot and was later arrested by Indiana State Police State a few blocks away.
Miller’s mother, Cindy Miller, said there was no drug deal and Duenas was “angry and drunk” when he ran over Davidson. She said her husband witnessed Duenas running over Davidson multiple times.
She said her son tried to save his brother-in law.
“He (Miller) broke the window of the car trying to get Duenas to stop,” she said. “They were really close.”
Cindy Miller said Davidson was a good man who had his whole life in front of him. She said Davidson and his wife were expecting his first child.
“He was excited about the baby,” she said. “He was a great kid. I lost everything.”
