NOTICE OF PUBLIC HEARING NAPPANEE CITY PLAN COMMISSION
    The City of Nappanee Plan Commission will hold a Public Hearing Thursday, May 11, 2017 at 7:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.
    The purpose of this Hearing is to conduct a Public Hearing on Petition #02-17-PLN filed by Abonmarche Consultants, Inc. 1009 South Ninth Street Goshen, IN 46526 for Heritage Farms, LLC 23965 US Hwy 6 Nappanee, IN 46550.  The petitioners are requesting a Preliminary Plat approval for a 13 lot subdivision to be known as Heritage Farms Addition Phase 4.
    Legal Description of Property:   
    A part of the Southwest Quarter (SW 1/4) of Section 29, Township 35 North, Range Five 5 East, Union Township, Elkhart County, Indiana and being more particularly described as follows:
    Commencing at the Northwest corner of said Southwest Quarter (SW 1/4) being monumented by a Harrison Monument found flush with the surface of the asphalt pavement; thence on and assumed bearing of South 90 degrees 00 minutes 00 seconds East along the North line of the Southwest Quarter (SW 1/4) of said Section 29, a distance of 1645.20 feet to a railroad spike found four inches below the asphalt pavement and monumenting the Northeast corner of a parcel of land owned by Jonas E. Hochstetler and Mary A. Hochstetler as recorded in the Office of the Recorder of Elkhart County in instrument number 96 017658 and the Point of Beginning of this description; thence continuing South 90 degrees 00 minutes 00 seconds East ALONG SAID North line of the Southwest Quarter (SW 1/4), a distance of 348.41 feet to a railroad spike found five inches below the asphalt pavement monumenting the Northwest corner of a parcel of land owned by Patrick N. Mishler as recorded in the Office of the Recorder of Elkhart County in instrument number 2003-26632; thence South 00 degrees 05 minutes 00 seconds East along the West line of said Mishler parcel, a distance of 760.00 feet to a 1/2 inch iron pipe found five inches above ground monumenting the Southwest corner of said Mishler parcel; a thence North 90 degrees 00 minutes 00 seconds West parallel with the North line of the Southwest Quarter (SW 1/4) of said Section 29, a distance of 351.01 feet to a 1/2 inch iron pipe found sic inches above ground monumenting the Northwest corner of a parcel of land owned by Ernest E. Chupp and Irene Chupp as recorded in the Office of the Recorder of Elkhart County in instrument number 0099-43086 said iron pipe also being located on the East line of Heritage Farms Residential Planned Development – Phase 3 as recorded in Plat Book 36, Page 39 in the Office of the Recorder of Elkhart County, Indiana; thence North 00 degrees 0 6 minutes 46 seconds East along the East line of said Heritage Farms Residential Planned Development – Phase 3, a distance of 123.05 feet to a set 5/8 inch rebar with cap stamped Brads-Ko 0041 monumenting the Northeast corner of said record Plat of Heritage Farms Residential Planned Development – Phase 3 (said rebar also monumenting the Southeast corner of the aforementioned Hochstetler parcel, instrument number 96 017658); thence North 00 degrees 06 minutes 46 seconds east along the east line of said Hochstetler parcel, a distance of 636.95 feet the aforementioned point of beginning.
    The above described parcel containing 6.101 acres more or less and being subject to all easement, restrictions and public right of way of record.
    A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered.
    All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
