Winona Tables Golf Cart Ordinance

WINONA LAKE- Winona Lake Town Council Tuesday tabled an ordinance concerning golf carts.

If approved, the ordinance would continue to allow golf carts to be driven on town streets with regulations. Requirements such as using a slow moving vehicle sign, requiring a licensed operator, and proof of insurance may be enforced.[[In-content Ad]]Town Coordinator Craig Allebach said the town does not currently have an ordinance that prohibits golf carts to be driven on the town's streets.

"Approving the ordinance would continue to allow residents to operate golf carts with regulations," Allebach said.

Town Attorney Jim Walmer said the Indiana legislature adopted house bill 1483 which clarifies the status of golf carts being used on public streets and highways.

The bill makes amendments to several statutes that focus on the general subject of motor vehicles. The statute states effective July 1, 2009, an individual is prohibited from operating a golf cart on a highway.

The bill also states if a council approves by ordinance the use of golf carts, then it may require the use of a slow moving vehicle sign and must require a valid driver's license and a minimum of financial responsibility.

"The state did not make it illegal to drive a golf cart on private property, however it permits a town to regulate a golf cart on private property," Walmer said.

Town Marshal Paul Schmitt said the town does not want to restrict golf carts in the town, but wants to follow the legislature's new bill.

Schmitt, Allebach, and Walmer will look over the bill and how it applies to the town and the topic will be discussed again at the council's July 21 meeting.

In other business, Town Council President Terry Howie said there is a small hole on the 900 block of Canal Street that he suggested be looked at.

Schmitt said the Winona Lake Police Department will apply for an $18,000 grant from the Indiana Criminal Justice Institute to purchase portable and mobile radios.

Schmitt said the department will find out in September if the department is awarded the grant.

The MasterWorks festival runs through Saturday. The Taste Of Winona will be Saturday in the village from 11 a.m. to 5 p.m.

The third annual event features eight wineries and six Kosciusko County restaurants that will be on the Village At Winona shops' porches, offering tastings of their finest creations.

The cost to attend the event is $10 per patron for wine tasting. Net proceeds support the Symphony of the Lakes.
