Winona Lake Man Arrested On Rape Charges

According to a press release from Warsaw Police Department, on April 6, officers were called to Kosciusko Community Hospital for a possible rape. Investigators found that in the early morning hours of April 6, Michael J. Elliott, 3101 Sandra Lane, Winona Lake, forced sexual acts with the 17-year-old family friend at her Warsaw residence.
According to an affidavit filed by the Kosciusko County Sheriff’s Department, Elliott entered the girl’s bedroom around 5 a.m., removed her clothing and forced her to engage in sex acts with him. The affidavit stated the victim told Elliott several times to stop and used the word “no.” She was able to punch and kick Elliott off of her and went into the bathroom and attempted to shut the door, though Elliott allegedly forced his way inside the bathroom.
The victim further stated that once inside the bathroom, Elliott held her down with his hands and forced her to submit to sex. The victim stated she was able to get away and went back to the bedroom, where Elliott allegedly told her, “This is just between me and you because I can get in real big trouble.”
An officer later spoke with Elliott, who said after everyone went to sleep, he entered the girl’s room and performed sex acts on her and said she appeared frightened and went to the bathroom. He said he followed her into the bathroom to comfort her, but proceeded to have sex with her. He told police she appeared frightened and he realized what he had done, and the girl went back into the bedroom.
Warsaw Police sought arrest warrants for rape, a class B felony, and sexual battery, a class D felony, against Elliott and served them Tuesday. Elliott was transported to the Kosciusko County Jail and booked on the charges with a $50,000 bond. He had not bonded out as of Wednesday morning.
Warsaw Police were assisted by the Winona Lake Police Department and the Kosciusko County Prosecuting Attorney's Office.
