Winona Approves Planned Unit Status For Village

Winona Lake - The Village at Winona will become a planned unit development to allow completed structural improvements to be recorded.

The Winona Town Council approved the planned unit development for the Village with a plat change to allow for curb extensions along Terrace Drive at the Winona Town Council's meeting Wednesday.

The planned unit development will include rededicating Terrace Drive and a section of Park Avenue from 9th Street to Kings Highway.

The plan also will include recording downtown Winona Lake structural building improvements including structure improvements to the Boathouse Restaurant, hotel and parking areas in the town.

Brent Wilcoxson, managing director for the Village, presented design plans for the planned unit development at the council's Dec. 12 meeting.

The Winona Plan Commission approved preliminary approval of the planned unit development in 1998 when attorney Richard Helm, representing Winona Restoration Partners LLC, filed the original planned unit development.

The council voted to table final approval for the planned unit development at the Dec. 12 meeting to allow council members to review the plans.

Town Council President Rolly Ortega expressed concern at Wednesday's meeting with the project needing more right of way room for curbs to be widened to allow for street lights. The council voted to add a plat change to the planned unit development to allow for an additional two to three feet of curb east of Terrace Drive.

Town engineer Larry Long said the plat change will be an additional $500 to $600 that the town will pay.

Wilcoxson said any new structures coming before the town still will need to be approved by the Winona Plan Commission and Winona Town Council.

The council also approved Mitch Titus to serve as the new Winona Lake fire chief. Titus will replace Roger Gelbaugh who announced his resignation at the council's Dec. 12 meeting. Gelbaugh's resignation will be effective Sunday. Titus will begin his duties as fire chief Monday.

The council approved vacations at Kings Court and Kings Highway. The council tabled two other vacations of public rights of way at Elder Lane and at the end of Park Avenue where it turns into Lakeshore to further discuss the vacations at its Jan. 9 meeting.

The council discussed the vacation of rights of way during its Nov. 28 and Dec. 12 meetings when public hearings were held.

Long said during the council's Dec. 12 meeting he would look at the Park Avenue area proposed to be vacated with town attorney Jim Walmer.

Long said during Wednesday's meeting Walmer informed him the vacation was part of a court case in the past, and there were issues of who would own the area if it is vacated.

Ortega expressed his concern with vacating the end of Park Avenue.

"I have concern with vacating one of our last lake accesses," Ortega said. "I need more convincing before I agree to vacate the Park Avenue area."

The council also:

• Approved an ordinance to amend the Winona Lake Personnel Handbook to reflect changes in time over duty hours and overtime for the police department. In addition, there are changes to vacation that takes the maximum time allowed from three weeks to four weeks for town employees.

• Approved a change order payment for $173,692.04 for Wooster Road improvements. Long said the contractor has completed $170,392.04 of the work and $3,300 work remains. He recommended the town retain 5 percent of the completed work, or $8,519.60, and pay the contractor $161,872.44.

• Approved an ordinance transferring unused money from the General Fund Appropriation accounts and the Motor Vehicle Highway Fund Appropriation accounts.

• Approved an encumbrance ordinance from 2006 to 2007 including $7,300 for the Winona Police Department for salaries. The town of Winona Lake clerk-treasurer's office will encumber money from the 2005 general fund to the 2006 budget with a total of $15,772.75 for two weeks of 2006 wages paid in 2007 and purchase orders. The encumbrance includes the town coordinator at $1,800; clerk-treasure salary at $1,210; office salary at $2,000; building commissioners salary at $1,145; retirement and Social Security at $600; and fire capital expenditures at $1,717.75.

The town of Winona Lake Street Department established proof of need to encumber money from the 2006 Motor Vehicle Highway Fund for the 2007 budget totaling $105,950. The encumbrances include $500 for the town coordinator salary, $750 for the clerk-treasurer salary, $500 for the office salary, $200 for payroll taxes and $104,000 for road and street construction.

• Approved an ordinance amendment to account for changes made related to the town's health insurance plan and Health Savings Plan. The agreement allow those who are not on the plan to be paid $100 or $50 a month because they lost the medical benefits the town previously provided.

• Approved an agreement between Winona Lake and Wayne Township for Wayne Township to provide $13,700 for fire services and $8,000 for park services for Winona Lake.

Ortega gave an update on upcoming events in Winona Lake including the YMCA Frigid 5K at Winona Lake Park Monday at 1 p.m., and Talk of the Town on 107.3 with Rolly Ortega Jan. 15 at 2 p.m.
