Warsaw Planner Approve Plats, Holds Public Hearing On Fences, Discusses Flood Plains

The commission approved a request from petitioner Kim Hart for a preliminary plat at Country Club Road and Shay Lane.
A preliminary and final plat was approved from applicant Greenberg Farrow for replating of the Petro family subdivision on the southwest coner of CR 300N and Shelden Street.
The commission also held a public hearing for fences and a clearance and accessory structures ordinance.
The commission approved sending a favorable recommendation to Warsaw City Council to approve the ordinance.
The ordinance states in order to provide clear unobstructed vision and lateral clearance along public right of ways, the following requirements must apply: no fence or visual obstruction, including plants, are allowed to be erected within the space horizontally 10 feet from the travel surface of a street or 3 feet of the travel surface of an alley and vertically between 3 feet and 8 feet high.
Accessory structures may be operated and maintained under the same ownership and on the same lot or adjoining lots as the principal use. If the accessory building is on an adjoining lot, the owner must provide a restrictive covenant which stipulates that the adjoining lots will not be sold separately from each other.
The accessory building must be used for the storage of personal property only and not be used for any commercial or industrial purpose.
Jeremy Skinner, city planner, said he will have an ordinance at the next meeting on an update on the city’s flood plain ordinance. A public hearing will need to be held on the flood plain and city council will need to approve the ordinance.
The flood plain maps will take effect when the city passes the ordinance and the city has until Sept. 30 to do so.
“Failure for us to do it by that date means we are no longer protected by FEMA, which means if there is a flood there is no FEMA money, so we will get this done before September,” Skinner said.
