Warsaw Man Charged with Incest

The 39-year-old man is charged by Kosciusko County prosecutors with the Class C felony, less than three weeks after his daugher reported he made her perform a sex act on him and they had sex, according to the man’s probable-cause affidavit, filed Tuesday in Kosciusko Superior Court. He is being held in Kosciusko County Jail in lieu of a $5,000 bond.
The Times-Union is not naming the man to protect the identity of the victim.
A secretary at Warsaw Community High School contacted the Warsaw Police Department on May 20, when the girl reported the man had forced a sexual relationship on her, typically whenever he drinks, the affidavit said. The girl told the secretary that the man then touches her “all over”, the affidavit said.
During an interview with Warsaw Police Lee Ann Roby three days later, though, the girl said the over the previous weekend of May 21-22, the man made the girl perform sex acts on him and forced her to have sex, according to the affidavit.
The girl told Roby that like occurrences have been going on every weekend since January - roughly 36 times, the affidavit said.
The man admitted to Roby to the acts, though saying he had sex just 10 times with the girl.
According to Indiana Code, incest is defined as a person 18 years or older who engages in sexual intercourse or deviate conduct with a biological family member. A Class C felony holds a sentencing range of 2-8 years in prison, per Indiana Code.
