Variances Allowed Along Swick Meredith Drain

Along the Swick Meredith drain, the Kosciusko County Drainage Board approved two requests for variances today.

Richard Dickerhoff wants to construct a building no closer than 50 feet from the top of the Swick Meredith ditch. Ordinances require a 75-foot setback. The Dickerhoffs are replacing a mobile home with a house. The property is south of Mentone.

Dick Kemper, county surveyor, said his department could still get the ditch cleaned and maintained and therefore was OK with the variance.

The board approved the variance request unanimously.

Phil Kreider built a garage closer than the ordinances allow to the Swick Meredith drain. He had received a permit with a site plan showing a 75-foot setback, but not only did not meet that setback, but also built the garage in a flood plain.

The Kosciusko County Area Plan Commission sent Kreider a letter notifying him of his violation, according to Kemper, telling him he had to get a variance from the Board of Zoning Appeals to allow the garage to remain because of it being in a flood plain. Kreider went before the BZA but cannot get his after-the-fact permit until the Drainage Board approves his variance for a setback from the drain.

The Drainage Board approved Kreider's request on the condition that Kreider return the proper variance forms completed and signed to the surveyor's office. The Drainage Board can't sign the variance themselves until their Dec. 16 meeting.

Members of the Drainage Board are county commissioner Ron Truex, Donald Goon, Dorris Harrold, Maurice McDaniel and Eldon Watkins. They meet at 9 a.m. on the fourth Thursday of every month in the county courthouse, Warsaw. Due to the holidays, their December meeting was changed to Dec. 16. [[In-content Ad]]
