NOTICE OF ADOPTION OF A RESOLUTION BY
THE TOWN OF MILFORD, INDIANA, REDEVELOPMENT COMMISSION AMENDING, ENLARGING AND EXTENDING THE TIME OF EXPIRATION
FOR THE ALLOCATION AREA IN THE MILFORD ECONOMIC DEVELOPMENT AREA NO. 1, NOTICE OF APPROVAL BY THE KOSCIUSKO COUNTY
AREA PLAN COMMISSION AND OF AN APPROVAL RESOLUTION BY THE TOWN COUNCIL
OF THE TOWN OF MILFORD, INDIANA
NOTICE OF PUBLIC HEARING
    NOTICE IS HEREBY GIVEN that on December 9, 2013, the Town of Milford, Indiana, Redevelopment Commission will review and conduct a public hearing upon, the following items:
    a.    Extension of Resolution No. 2-1-96 of the Town of Milford, Indiana, Redevelopment Commission created the Milford Economic Development Area No. 1 (hereinafter "Area No. 1") as an economic development area pursuant to Indiana Code 36-7-14.
    b. The Town of Milford, Indiana, Redevelopment Commission adopted Resolution No. 2013-1 by which it enlarged and extended the resolution, plan and allocation area for Area No. 1 for an additional period of 10 years, with the Milford Economic Development Area No. 1 to run for a period of 30 years rather than 20 years, and the allocation area also to run for a period of 30 years rather than 20 years, expiring on February 12, 2026.
    c. The Resolution of the Kosciusko County Area Plan Commission dated September 4, 2013, approving the above described Resolution No._____of the Town of Milford, Indiana, Redevelopment Commission.
    d. The Resolution of the Town Council of the Town of Milford, Indiana, approving the Order of the Kosciusko County Area Plan Commission, approving the Declaratory Resolution of the Town of Milford, Indiana, Economic Redevelopment Commission for the Economic Development Area No. 1, Resolution No. 2013-2.
    All of the above are for the purpose of amending, extending and enlarging the expiration date for the Area No. 1 resolution, plan, and the allocation area from 20 years to 30 years.
    A further description of the area affected together with a copy of the Town of Milford, Indiana, Redevelopment Commission and the other Resolutions listed above are available and may be inspected at the office of the Clerk-Treasurer for the Town of Milford, Indiana, 121 South Main Street, Milford Indiana 46542.
    The Town of Milford, Indiana, Economic Development Area No. 1 is more particularly described as the following real estate in Kosciusko County, Indiana, to-wit:
    Description of Project Area.
    The, "Milford Economic Development Area No, 1" is located in the Town of Milford and is described as that area contained in maps and plats, made a part of this Plan.
    The Milford Redevelopment District is more particularly described as follows:
    Beginning at a point at the northwest corner of the property currently owned by Harlan and Nancy Wuthrich, described as Plat number 20-29-26, and thence along the northern edge of County Road 1300  extended, to a point at the West edge of the Old State Road 15   Right-of-Way;
    AND thence South, along said Right-of Way, to the northeast corner of a property described as Plat number 20-34-l.AC; thence West along the northern property line of said property to the northwest corner of same; thence South along the West property line of said property and continuing South along the West property lines of properties described as Plat numbers 20-34-1.AE.  20-.14-l . AA,   20-34-1.AD and 20-34-1.AB, to the  North property line or  Plat   number 20-34-1.B;
    AND thence West along the North property line of the property described as Plat number 20-34-1.B, to the northwest corner of said property; thence South along the West property line of said property, and continuing South along the West property lines of properties described as Plat numbers: 20-34-2, 20-34-4, and 20-34-5, to the southwest corner of the property described as Plat number 20-34-5; thence East along the South property line of said property and continuing in the same direction to the West edge of the Old State Road 15 Right-of-Way; thence North along the West edge of said Right-of-Way to the northwest corner of a property described as Plat number 20-34-1; thence East along the North property line of property described    Plat number 20-34-14 to the northeast corner of same;
    AND thence South along the East property line of said property to the North property line of the property described as Plat number
27-34-20.B; thence West  along the North property line of said property to the northwest corner of same; thence South along the West property line of the property described as Plat number 27-34-13, to the South edge of the Syracuse Street right -of-way
    AND thence West along the South edge of the Syracuse Street Right-of Way to the West edge of the State Route 15 Right-of-Way; thence North along the East edge of said Right-of-Way to the northeast corner of the property described thence West along the North property line of said property to the northwest corner of same; thence North along the East  property line of the property 20-29-17  to    the   northeast corner of said property; thence West along the North Property line of said property and continuing West along the North property lines of properties described as Plat numbers 20-29-18, 20-29-19  and 20-29-20 to the southeast corner of the property described as Plat number 20-29-27D; thence north line of said property to the northeast corner of same; thence East along the South property line of the property described as Plat number 20-29-27E to the southeast corner of said property;. thence North along the East property line of said property to the northeast corner of same; thence West along the North property line of said property to the Right-of-Way;
    AND thence North along the West edge of the Kinwood Drive Right-of-Way to its end; thence West along the North edge of said Right-of-Way and continuing West along the North property; lines of properties described as Plat number 20-29-39, 20-29-38, and 20-29-37 to the southwest cornet of the property described as Plat number 20-29-26;  thence North along the West property line of said property to the Point of Beginning; containing 239:2 5 acres more or less.
    The substance of the Resolutions to be approved are to allow tax increment financing, a tax increment financing district, an Economic Area No. 1, and the allocation area for Economic Development Area No. 1, all to be amended, enlarged and extended for a period of 10 additional years, with an expiration date for Area No. 1 and the allocation area of February 12, 2026, for the purpose of continued funding of construction and installation of public infrastructure within the Area No. 1 as well as for all other matters permitted by Indiana for a TIF economic development area.
    You are FURTHER NOTIFIED that December 9, 2013, at 10 o'clock a.m., at the Town Hall for the Town of Milford, Indiana, the Town Council will receive and hear all comments, remonstrances, and objections, from interested persons or from anyone else who may attend. In addition, anyone may, prior to the meeting, submit to the Clerk-Treasurer of the Town of Milford, Indiana, any written comments, and those written comments will be considered at the hearing. After hearing, the Town Council for the Town of Milford, Indiana, will and shall take final action with regard to the proposed amendment and enlargement of expiration date for Milford Economic Development Area No. 1 and its allocation area, and shall pass a Resolution with regard to confirming and adopting the Resolutions so amending.
