Superior Court III
The following violation were recently admitted and adjudged in Kosciusko Superior Court III with Judge Joe V. Sutton presiding. Unless otherwise indicated, the conviction is for a Class D felony. The month the incident occurred is included to eliminate confusion.
The following people also paid $132.50 in court costs during sentencing between Nov. 7 and Dec. 2:
Driving While Intoxicated - Fined $17.50 from a January arrest, sentenced to 18 months in prison, of which all but 60 days were suspended for probation; ordered to pay a $200 alcohol interdiction fee, to complete a substance abuse evaluation and to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended one year was Tammy L. Easterday, 35, Warsaw. The jail term can be served in work release if Easterday is qualified and accepted to it.
Fined $67.50 from an August arrest, sentenced to 24 months in prison, of which 22 months were suspended for probation; ordered to pay a $200 alcohol interdiction fee, to complete a substance abuse evaluation, to attend a session of the Drunk Driving Impact Panel and to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended one year was Ryan Andrew Hively, 27, Warsaw. The jail term can be served in work release if Hively is qualified and accepted to it.
Fined $67.50 from a June arrest, sentenced to 36 months in prison, of which 24 months were suspended for probation; ordered to pay a $200 alcohol interdiction fee, to complete a substance abuse evaluation and to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended one year was Terry E. Powell, 39, Warsaw. The jail term can be served in work release if Powell is qualified and accepted to it.
Also, Powell was fined $100 and sentenced to 36 months in jail for resisting law enforcement, a Class D felony. Twenty-four months of the term were suspended for probation, with the balance ordered served concurrently.
Fined $67.50 from a September arrest, sentenced to 36 months in prison, of which 24 months were suspended for probation; ordered to pay a $200 alcohol interdiction fee, to complete a substance abuse evaluation, to attend a session of the Drunk Driving Impact Panel and to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended one year was Mika J. Shepherd, 24, Claypool. The jail term can be served in work release if Shepherd is qualified and accepted to it.
Also, Shepherd was fined $500 and sentenced to 36 months in jail for possession of marijuana, a Class D felony. Thirty months of the term were suspended for probation, with the balance ordered served concurrently.

Dulworth, 50, Claypool. The jail term can be served in work release if Dulworth is qualified and accepted to it.
Fined $1,000 from a July arrest, sentenced to three years in prison, of which 12 months were suspended for probation; ordered to pay a $200 alcohol interdiction fee, to complete an alcohol treatment program and to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended two years was Clinton Gerold Hursey, 25, Cromwell. The jail term can be served in work release if Hursey is qualified and accepted to it.
Driving While Intoxicated (Class A Misdemeanor)- Fined $167.50 from an August arrest, sentenced to 12 months in prison, of which 11 months were suspended for probation; ordered to pay a $200 alcohol interdiction fee, to complete a substance abuse evaluation, to attend a session of the Drunk Driving Impact Panel and to pay a $25 initial and $10 monthly probation user's fee; and driving privileges suspended one year was Danny M. Perry, 49, Leesburg. The jail term can be served in work release if Perry is qualified and accepted to it.
