Superior Court III
The following violation were recently admitted and adjudged in Kosciusko Superior Court III with Judge Joe V. Sutton presiding. Unless otherwise indicated, the conviction is for a Class D felony. The month the incident occurred is included to eliminate confusion.

Criminal Recklessness Causing Serious Bodily Injury - Fined $167.50 from a January arrest; sentenced to 36 months in jail, of which 18 months were suspended; ordered to reimburse Edward A. Walters for uninsured medical bills, to pay a $50 initial and $15 monthly probation user's fee and to complete a substance abuse evaluation and follow any recommendations for treatment; and driving privileges suspended two years, was Gary W. Driving While Intoxicated - Fined $67.50 from a March arrest; sentenced to 18 months in jail, of which 16 months were suspended for probation; ordered to pay a $200 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee and to complete a substance abuse evaluation and follow any recommendations for treatment and to attend a session of the Drunk Driving Impact Panel; and driving privileges suspended one year, was Marcus B. Driving While Intoxicated (Class A Misdemeanor) - Fined $67.50 from a February arrest; sentenced to 10 days in jail; ordered to pay a $200 alcohol countermeasure fee and a $50 initial and $15 monthly probation user's fee and to complete a substance abuse evaluation and follow any recommendations for treatment and to attend a session of the Drunk Driving Impact Panel; and driving privileges suspended one year was Michael K. Waggoner, 39, Syracuse. The jail term can be served in work release if Waggoner is qualified for and accepted to the program.
Also, for a charge of being a habitual traffic violator, a Class C felony, Waggoner was sentenced to 48 months in jail, of which 24 months were suspended for probationm and his driving privileges were suspended for life.

Nonsupport Of A Dependent Child - Given a three-year suspended jail term from a July arrest and ordered to pay all current support obligations as they become due, plus an additional $25 per week toward the arrearage, and a $50 initial and $15 monthly probation user's fee was Colleen Baldwin, 31, Syracuse.
Given a 36-month suspended jail term from a July arrest and ordered to pay all current support obligations as they become due, plus an additional $20 per week toward the arrearage, and to consume no alcoholic beverages was Jessica Mullins, 26, Claypool.
Given a 36-month suspended jail term from a July arrest and ordered to pay all current support obligations as they become due, plus an additional $20 per week toward the arrearage, and to consume no alcoholic beverages was Stacy Slusher.
Possession Of Marijuana - Fined $68 from a January arrest; sentenced to 36 months in jail, of which 30 months were suspended for probation; and ordered to pay a $50 initial and $15 monthly probation user's fee and to complete a substance abuse evaluation and follow any recommendations for treatment was L. Matthew Waggoner, 36, Warsaw.
Habitual Traffic Violator - Fined $167 from an October 2001 arrest; sentenced to 18 months in jail, of which 16 months were suspended for probation; and ordered to pay a $50 initial and $15 monthly probation user's fee was Roland Gonzalez, 48, Etna Green.
Habitual Traffic Violator (Class C Felony) - Sentenced from a January arrest to 48 months in jail, of which 24 months were suspended for probation; ordered to pay a $50 initial and $15 monthly probation user's fee and to attend a session of the Drunk Driving Impact Panel; and driving privileges suspended for life was Ricky D. Allen, 40, Warsaw.
Also, for a charge of driving while intoxicated, a Class A misdemeanor, Allen was fined $67.50, ordered to pay a $200 alcohol countermeasure fee and his driving privileges suspended one year. The jail terms were ordered served concurrently.
Fined $170.50 from a March arrest and sentenced to four years in jail, of which two years were suspended for probation, was Robert L. Nine Jr., Warsaw. The jail term can be served in work release if Nine is qualified for and accepted to the program.
