Superior Court III
The following violations were recently admitted and adjudged in Kosciusko Superior Court II with Judge Joe V. Sutton presiding. Unless otherwise indicated, the conviction is for a Class D felony. The month the incident occurred is included to eliminate confusion.
The following people also paid $129.50 in court costs during sentencing between Aug. 1 and Aug. 30:
Driving While Intoxicated - Sentenced from an August 2000 offense to 1-1/2 years in jail; ordered to pay a $200 alcohol and drug fee; and driving privileges suspended two years was Luke M. Plank, 22, Warsaw. Plank also was sentenced to three years in prison for being a habitual substance offender. The term was ordered served consecutive to the DWI conviction.
Fined $100 for a February offense; sentenced to 1-1/2 years in jail, of which all but 60 days were suspended for probation; ordered to pay a $300 alcohol interdiction fee, make restitution for the property damage accident and complete an alcohol treatment program; and driving privileges suspended one year was Miguel A. Mencias, 28, Warsaw. The jail term can be served in the county's work release program if Mencias is qualified for and accepted to it.
Fined $200 for a May offense; sentenced to three years in jail, of which two years were suspended for probation; ordered to pay a $300 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend a Drunk Driving Impact Panel meeting; and driving privileges suspended one year was Scott A. Rucker, 46, Winona Lake. The jail term can be served in the county's work release program if Rucker is qualified for and accepted to it.
Fined $100 for an April offense; sentenced to two years in jail, of which all but 90 days were suspended for probation; ordered to pay a $300 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend a Drunk Driving Impact Panel meeting; and driving privileges suspended one year were Michael S. Brown, 31, Pierceton, and April M. Prater, 22, Warsaw. The jail terms can be served in the county's work release program if the defendants are qualified for and accepted to it.
Fined $300 for an January offense; sentenced to three years in jail, of which one year was suspended for probation; ordered to pay a $300 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend a Drunk Driving Impact Panel meeting; and driving privileges suspended one year was Clarence Allan Boswell III, 31, Warsaw.
Fined $300 for a May offense; sentenced to three years in jail, of which all but 1-1/2 years were suspended for probation; ordered to pay a $300 alcohol interdiction fee, the cost of his court-appointed attorney and a $50 initial and $15 monthly probation user's fee and to complete an alcohol treatment program; and driving privileges suspended two years was Charles R. Willard, 48, Warsaw. The jail term can be served in the county's work release program if Willard is qualified for and accepted to it.

Harvey, 49, Syracuse. The jail term can be served in the county's work release program if Harvey is qualified for and accepted to it.
Fined $200 for a March offense; sentenced to three years in jail, of which two years were suspended for probation; ordered to pay a $300 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to attend a Drunk Driving Impact Panel meeting and to attend Alcoholics Anonymous three times a week for 12 weeks; and driving privileges suspended two years was Betty J. Tompkins, 62, Syracuse. The jail term can be served in the county's work release program if Tompkins is qualified for and accepted to it. Tompkins also was sentenced to 60 days in jail (to be served concurrently) for failure to stop after a property damage accident and her license was suspended 90 days.

Habitual Traffic Violator - Fined $100 for an April offense; sentenced to one year in jail, of which 180 days were suspended for probation; and driving privileges suspended for life was Russell T. Dellinger, 37, North Manchester. The jail term can be served in the county's work release program if Dellinger is qualified for and accepted to it.
Nonsupport Of A Child - Fined $1 for a June offense; sentenced to three years in jail, of which 1-1/2 years were suspended for probation; and ordered to pay child support as it becomes due, plus $1,000 per year toward the arrearage was Michael C. Kistner, 24, Pierceton. The jail term can be served in the county's work release program if Kistner is qualified for and accepted to it.
Fined $1 for a July 2000 offense; sentenced to three years in jail, of which two years were suspended for probation; and ordered to pay child support as it becomes due, plus $3,500 per year toward the arrearage, and the cost of his court-appointed attorney was David M. Rivich, 26, Claypool. The jail term can be served in the county's work release program if Rivich is qualified for and accepted to it.
Fined $1 for an April offense and sentenced to three years in jail was Randy Lamb, 34, Syracuse. The jail term was ordered served consecutively to two convictions in Kosciusko Superior Court I.
Fined $1 each for two July offenses; sentenced in each case to three years in jail, of which two years were suspended for probation; and ordered to pay child support as it becomes due, plus $5,000 per year toward the arrearage in one case and $3,000 per year toward the arrearage in the other case, was Michael Stacy, 30, Pierceton. The jail terms were ordered served consecutively and can be served in the county's work release program if Stacy is qualified for and accepted to it.
Nonsupport Of A Child (Class A Misdemeanor) - Fined $1 for an April offense; sentenced to two years in jail, all of which was suspended for probation; and ordered to pay child support as it becomes due, plus $528.49 on the sentencing date was Michael P. O'Connell, 41, Claypool.
