Superior Court III
The following violation were recently admitted and adjudged in Kosciusko Superior Court III with Judge Joe V. Sutton presiding. Unless otherwise indicated, the conviction is for a Class D felony. The month the incident occurred is included to eliminate confusion.
The following people also paid $129.50 in court costs during sentencing between June 3 and July 31:
Driving While Intoxicated - Fined $20.50 from a December offense; sentenced to 16 months in prison, of which all but 60 days were suspended; ordered to pay a $200 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and attend one Drunk Driving Impact Panel session; and driving privileges suspended one year was Dalmacio Gutierrez, 29, Warsaw. The prison term can be served in work release if Gutierrez is qualified for and accepted to the program.
Fined $120.50 from a February offense; sentenced to 18 months in prison, of which 12 months were suspended; ordered to pay a $200 alcohol countermeasure fee, to complete an alcohol treatment program and attend one Drunk Driving Impact Panel session; and driving privileges suspended one year was Felix O. Ihrue, 38, Warsaw.
Also, for the offense of possession of marijuana, a Class A misdemeanor, Ihrue is ordered to pay a $200 drug interdiction fee and his driving privileges are suspended six months. For the offense of being a habitual traffic violator, a Class D felony, Ihrue is sentenced to 18 months in prison, of which 12 months were suspended; and his driving privileges are suspended for life. The prison terms are ordered served concurrently and can be served in work release if Ihrue is qualified for and accepted to the program.
Fined $20.50 from a March offense; sentenced to 30 months in prison, of which 28 months were suspended; ordered to pay a $200 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program, to attend one Drunk Driving Impact Panel session and not to consume any alcoholic beverages or enter any establishments where alcohol is the primary product for sale; and driving privileges suspended one year was John W. Perkins Jr., 24, Warsaw. The prison term can be served in work release if Perkins is qualified for and accepted to the program.
Fined $20.50 from a March offense; sentenced to 36 months in prison, of which 34 months were suspended; ordered to pay a $200 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete a substance abuse evaluation and follow any recommendations for treatment; and driving privileges suspended one year was Cody Bruce Dininger, 22, Warsaw. The prison term can be served in work release if Dininger is qualified for and accepted to the program.
Fined $20.50 from a March offense; sentenced to 36 months in prison, of which 24 months were suspended; ordered to pay a $200 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program, to attend one Drunk Driving Impact Panel session and not to consume any alcoholic beverages; and driving privileges suspended one year was Michael E. Baumgartner, 52, Syracuse. The prison term can be served in work release if Baumgartner is qualified for and accepted to the program.
Also, for the offense of being a habitual traffic offender, a Class D felony, Baumgartner's driving privileges are suspended for life.
Fined $20.50 from a March offense; sentenced to 36 months in prison, of which 30 months were suspended; ordered to pay a $200 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel session; and driving privileges suspended one year was Paul M. Stearley, 42, Leesburg. The prison term can be served in work release if Stearley is qualified for and accepted to the program.

The prison term can be served in work release if Rodriguez is qualified for and accepted to the program.
Fined $67.50 from an April offense; sentenced to three years in prison, of which 34 months were suspended; ordered to pay a $200 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee and to complete a substance abuse evaluation and follow any recommendations for treatment; and driving privileges suspended one year was Robert D. Rice, 42, North Webster. The prison term can be served in work release if Rice is qualified for and accepted to the program.
Driving While Intoxicated (Class C Misdemeanor) - Fined $170.50 from a January offense; sentenced to 60 days in prison; ordered to pay a $200 alcohol countermeasure fee; and driving privileges suspended 60 days was Jerry L. Sheets, 40, Pierceton.
Also, for the offense of being a habitual traffic offender, a Class D felony, Sheets is sentenced to 36 months in prison, of which 18 months were suspended; ordered to pay a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and an anger management class; and his driving privileges were suspended for life. The prison terms are ordered served consecutively and can be served in work release if Sheets is qualified for and accepted to the program.
Driving While Intoxicated (Class A Misdemeanor) - Fined $25 from a March offense; sentenced to one year in prison, of which all but 60 days were suspended; ordered to pay a $200 alcohol countermeasure fee and a $25 initial and $10 monthly probation user's fee, to complete a substance abuse evaluation and follow any recommendations for treatment and to attend one Drunk Driving Impact Panel session; and driving privileges suspended one year was Adrienne Hernandez, 23, Warsaw. The prison term can be served in work release if Hernandez is qualified for and accepted to the program.
Driving While Adjudged A Habitual Traffic Offender - Fined $167.50 from an August 2001 offense; sentenced to 36 months in prison, of which 30 months were suspended; ordered to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended for life was Fred A. James, 34, Warsaw. The prison term can be served in work release if James is qualified for and accepted to the program.
Fined $167.50 from an October offense; sentenced to 36 months in prison, of which 30 months were suspended; ordered to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended for life was Jeannie L. Fretz, 40, Syracuse. The prison term can be served in work release if Fretz is qualified for and accepted to the program.
Fined $270.50 from a December offense; sentenced to 36 months in prison, of which 30 months were suspended; ordered to complete an alcohol treatment program, to pay a $50 initial and $15 monthly probation user's fee and to make restitution for property damages not covered by insurance; and driving privileges suspended for life was David W. Douglas, 30, Silver Lake. The prison term can be served in work release if Douglas is qualified for and accepted to the program.
Fined $170.50 from a December offense; sentenced to 18 months in prison, of which 12 months were suspended; ordered to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended for life was Tonya Clow, 47, Syracuse. The prison term can be served in work release if Clow is qualified for and accepted to the program.
Fined $170.50 from an April offense; sentenced to 12 months in jail, of which 11 months were suspended; ordered to complete an alcohol treatment program and to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended for 180 days Charles Fenix, 37, Mentone.
Dismissal
Driving While Intoxicated - Kim Leake, 48, Warsaw. After a mistrial was declared in this case on July 11, 2001, the matter was rescheduled for trial and the judge has since concluded that the mistrial was declared in error. Therefore, the case cannot now be retried because of the double jeopardy rule. The case was dismissed with prejudice, which means a new case cannot be brought against Leake in this matter.

Superior Court II

Also, for the offense of possession of marijuana, a Class A misdemeanor, Ihrue is ordered to pay a $200 drug interdiction fee and his driving privileges are suspended six months. For the offense of being a habitual traffic violator, a Class D felony, Ihrue is sentenced to 18 months in prison, of which 12 months were suspended; and his driving privileges are suspended for life. The prison terms are ordered served concurrently and can be served in work release if Ihrue is qualified for and accepted to the program.

Dismissal
Driving While Intoxicated - Kim Leake, 48, Warsaw. After a mistrial was declared in this case on July 11, 2001, the matter was rescheduled for trial and the judge has since concluded that the mistrial was declared in error. Therefore, the case cannot now be retried because of the double jeopardy rule. The case was dismissed with prejudice, which means a new case cannot be brought against Leake in this matter.
