Superior Court III
The following violations were recently admitted and adjudged in Kosciusko Superior Court II with Judge Joe V. Sutton presiding. Unless otherwise indicated, the conviction is for a Class D felony. The month the incident occurred is included to eliminate confusion.
The following people also paid $125.50 in court costs during sentencing between June 7 and June 27:
Driving While Intoxicated - Fined $100 in January; sentenced to 21 months in jail, which can be served in the county's work release program if he is qualified and accepted to it; ordered to pay a $300 state alcohol countermeasure fee; and driving privileges suspended two years was Randy J. Morris, 41, Bourbon.
Fined $100 in December; sentenced to 1-1/2 years in jail, of which all but 60 days were suspended for probation; ordered to complete an alcohol treatment program, to attend a session of the Drunk Driving Impact Panel, to attend Alcoholics Anonymous and to pay a $300 state alcohol countermeasure fee and a $50 initial and $15 monthly probation user's fee; and driving privileges suspended one year was Linda S. Long, 44, Syracuse. The jail term can be served in the work release program if Long is qualified and accepted to it.
Fined $50 in January; sentenced to one year in jail, of which all but 60 days was suspended for probation; ordered to pay a $200 state alcohol countermeasure fee; and driving privileges suspended one year was Kelly A. Howard, 36, Warsaw. The jail term can be served in the work release program if Howard is qualified and accepted to it.
Fined $100 in April; sentenced to two years in jail, of which all but 120 days were suspended for probation; ordered to complete an alcohol treatment program and to pay a $300 state alcohol countermeasure fee; and driving privileges suspended one year was Eric C. Meyer, 30, Leesburg. The jail term was ordered served consecutively to a conviction in Elkhart County and can be served in the work release program if Meyer is qualified and accepted to it.
Fined $200 in August 2000; sentenced to three years in jail, of which two years were suspended for probation; ordered to complete an alcohol treatment program, to attend a session of the Drunk Driving Impact Panel, to make restitution for any property damage resulting from this case and to pay a $300 state alcohol countermeasure fee; and driving privileges suspended one year was Jackie D. Hurt Jr., 26, Pierceton.
Habitual Traffic Violator - Fined $300 in February; sentenced to three years in jail, of which 1-1/2 years were suspended for probation; ordered to complete an alcohol treatment program, to attend a session of the Drunk Driving Impact Panel and to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended for life was Daniel D. Jensen, 38, Warsaw.
Jensen also was ordered to pay a $300 state alcohol countermeasure fee and sentenced to one year in jail for driving while intoxicated, a Class A misdemeanor. The jail terms were ordered served concurrently and can be served in the work release program if Jensen is qualified and accepted to it.
Habitual Traffic Violator (Class A misdemeanor) - Fined $100 in December 1999; sentenced to 90 days in jail; and driving privileges suspended 180 days was Gabe Walter Helms, 26, Milford. The jail term can be served in the work release program if Helms is qualified and accepted to it.
Fined $100 in December; sentenced to 90 days in jail; and driving privileges suspended one year was Terry L. Shumpert, 46, Leesburg. The jail term can be served in the work release program if Shumpert is qualified and accepted to it.
Possession Of Marijuana (Class A misdemeanor) - Sentenced for an October offense to one year in jail, of which all but 20 days was suspended for probation; ordered to pay a $200 state drug countermeasure fee and driving privileges suspended 180 days was Ronald W. Nelson Jr., 33, Warsaw. The jail term can be served in the work release program if Nelson is qualified and accepted to it.
Acquittal
Carlton Harwood, 32, of Warsaw, was acquitted during a May 2 jury trial of the following charges stemming from a December 1999 arrest: driving while intoxicated, both as a Class A misdemeanor and a Class D felony; driving with a blood-alcohol level of .10 percent or greater, both as a Class C misdemeanor and a Class D felony; and being a habitual substance offender, a Class C felony. The case was decided after the state rested and the defense moved for, and was granted, a directed verdict.

Bankruptcies
The following is an explanation of bankruptcy terms:
Chapter 7: Liquidation. A court-appointed trustee liquidates the assets of an individual or firm and distributes them to creditors on a prorated basis.
Chapter 11: Business reorganization. Debtor retains possession of assets and attempts to remain in business by proposing a plan of reorganization to pay all or a portion of debts from future earnings.
Chapter 13: For individuals with regular income. Often called "wage earner plan." Debtor retains assets and agrees to pay all or a portion of debts from future earnings over a three- to five-year period.
Chapter 12: The family farm bankruptcy proceeding. It is a hybrid between Chapter 13 and Chapter 11. A trustee is appointed, but the debtors remain in possession of their assets and propose to pay all or a portion of debts from future earnings over a three- to five-year period.

Superior Court III
The following violations were recently admitted and adjudged in Kosciusko Superior Court II with Judge Joe V. Sutton presiding. Unless otherwise indicated, the conviction is for a Class D felony. The month the incident occurred is included to eliminate confusion.
The following people also paid $125.50 in court costs during sentencing between June 7 and June 27:
Driving While Intoxicated - Fined $100 in January; sentenced to 21 months in jail, which can be served in the county's work release program if he is qualified and accepted to it; ordered to pay a $300 state alcohol countermeasure fee; and driving privileges suspended two years was Randy J. Morris, 41, Bourbon.
Fined $100 in December; sentenced to 1-1/2 years in jail, of which all but 60 days were suspended for probation; ordered to complete an alcohol treatment program, to attend a session of the Drunk Driving Impact Panel, to attend Alcoholics Anonymous and to pay a $300 state alcohol countermeasure fee and a $50 initial and $15 monthly probation user's fee; and driving privileges suspended one year was Linda S. Long, 44, Syracuse. The jail term can be served in the work release program if Long is qualified and accepted to it.
Fined $50 in January; sentenced to one year in jail, of which all but 60 days was suspended for probation; ordered to pay a $200 state alcohol countermeasure fee; and driving privileges suspended one year was Kelly A. Howard, 36, Warsaw. The jail term can be served in the work release program if Howard is qualified and accepted to it.
Fined $100 in April; sentenced to two years in jail, of which all but 120 days were suspended for probation; ordered to complete an alcohol treatment program and to pay a $300 state alcohol countermeasure fee; and driving privileges suspended one year was Eric C. Meyer, 30, Leesburg. The jail term was ordered served consecutively to a conviction in Elkhart County and can be served in the work release program if Meyer is qualified and accepted to it.
Fined $200 in August 2000; sentenced to three years in jail, of which two years were suspended for probation; ordered to complete an alcohol treatment program, to attend a session of the Drunk Driving Impact Panel, to make restitution for any property damage resulting from this case and to pay a $300 state alcohol countermeasure fee; and driving privileges suspended one year was Jackie D. Hurt Jr., 26, Pierceton.
Habitual Traffic Violator - Fined $300 in February; sentenced to three years in jail, of which 1-1/2 years were suspended for probation; ordered to complete an alcohol treatment program, to attend a session of the Drunk Driving Impact Panel and to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended for life was Daniel D. Jensen, 38, Warsaw.
Jensen also was ordered to pay a $300 state alcohol countermeasure fee and sentenced to one year in jail for driving while intoxicated, a Class A misdemeanor. The jail terms were ordered served concurrently and can be served in the work release program if Jensen is qualified and accepted to it.
Habitual Traffic Violator (Class A misdemeanor) - Fined $100 in December 1999; sentenced to 90 days in jail; and driving privileges suspended 180 days was Gabe Walter Helms, 26, Milford. The jail term can be served in the work release program if Helms is qualified and accepted to it.
Fined $100 in December; sentenced to 90 days in jail; and driving privileges suspended one year was Terry L. Shumpert, 46, Leesburg. The jail term can be served in the work release program if Shumpert is qualified and accepted to it.
Possession Of Marijuana (Class A misdemeanor) - Sentenced for an October offense to one year in jail, of which all but 20 days was suspended for probation; ordered to pay a $200 state drug countermeasure fee and driving privileges suspended 180 days was Ronald W. Nelson Jr., 33, Warsaw. The jail term can be served in the work release program if Nelson is qualified and accepted to it.
Acquittal
Carlton Harwood, 32, of Warsaw, was acquitted during a May 2 jury trial of the following charges stemming from a December 1999 arrest: driving while intoxicated, both as a Class A misdemeanor and a Class D felony; driving with a blood-alcohol level of .10 percent or greater, both as a Class C misdemeanor and a Class D felony; and being a habitual substance offender, a Class C felony. The case was decided after the state rested and the defense moved for, and was granted, a directed verdict.

The following estates, with an estimated value of $250,000 or more to be divided among the named beneficiaries, were filed in either Kosciusko Superior Court I or Kosciusko Circuit Court:

Bankruptcies
The following is an explanation of bankruptcy terms:
Chapter 7: Liquidation. A court-appointed trustee liquidates the assets of an individual or firm and distributes them to creditors on a prorated basis.
Chapter 11: Business reorganization. Debtor retains possession of assets and attempts to remain in business by proposing a plan of reorganization to pay all or a portion of debts from future earnings.
Chapter 13: For individuals with regular income. Often called "wage earner plan." Debtor retains assets and agrees to pay all or a portion of debts from future earnings over a three- to five-year period.
Chapter 12: The family farm bankruptcy proceeding. It is a hybrid between Chapter 13 and Chapter 11. A trustee is appointed, but the debtors remain in possession of their assets and propose to pay all or a portion of debts from future earnings over a three- to five-year period.
