Superior Court III
The following violation were recently admitted and adjudged in Kosciusko Superior Court III with Judge Joe V. Sutton presiding. Unless otherwise indicated, the conviction is for a Class D felony. The month the incident occurred is included to eliminate confusion.
The following people also paid $129.50 in court costs during sentencing between April 1 and May 31:
Driving While Intoxicated - Fined $20.50 for a February offense; sentenced to 24 months in jail, of which 22 months were suspended for probation; ordered to pay a $200 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend a parent counseling program and a Drunk Driving Impact Panel meeting; and license suspended one year was Shannon Schweitzberger, 27, North Webster. The jail term can be served in the Kosciusko County Work Release Program if Schweitzberger is qualified for and accepted to it.
Fined $300 for a November offense; sentenced to one year in jail, of which all but 60 days were suspended for probation; ordered to pay a $200 alcohol countermeasure fee, a $50 initial and $15 monthly probation user's fee and any restitution owed, to complete an alcohol treatment program and to attend a Drunk Driving Impact Panel meeting; and license suspended one year was Noe J. Marandet, 56, Warsaw. The jail term can be served in the Kosciusko County Work Release Program if Marandet is qualified for and accepted to it.
Fined $50 for a December 2000 offense, sentenced to six months in jail, ordered to pay a $200 alcohol countermeasure fee and license suspended one year was David J. Meckley, 40, Claypool. The jail term can be served in the Kosciusko County Work Release Program if Meckley is qualified for and accepted to it.
Fined $20.50 for a January offense; sentenced to three years in jail, of which two years were suspended for probation; ordered to pay a $200 alcohol interdiction fee and a $25 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend a Drunk Driving Impact Panel meeting; and license suspended one year was Steven A. Keim, 39, Syracuse. The jail term can be served in the Kosciusko County Work Release Program if Keim is qualified for and accepted to it.
Fined $120.50 for a January offense; sentenced to 18 months in jail, of which 16 months were suspended for probation; ordered to pay a $200 alcohol interdiction fee and a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend a Drunk Driving Impact Panel meeting; and license suspended one year was Todd L. Fined $1 for a May 2001 offense; sentenced to 1-1/2 years in jail, of which one year was suspended for probation; ordered to pay a $200 alcohol interdiction fee, a $25 initial and $15 monthly probation user's fee and $422 restitution to the Kosciusko County Probation Department, to complete an alcohol treatment program and to attend a Drunk Driving Impact Panel meeting; and license suspended one year was Ronald W. Habitual Traffic Violator - Fined $1.50 for a January 2001 offense; sentenced to 18 months in prison, of which 12 months were suspended for probation; ordered to pay a $50 initial and $15 monthly probation user's fee; and driving privileges suspended for life was David Gerth, 44, Leesburg. The prison term can be served in work release if Gerth is qualified for and accepted to the program.
Fined $170.50 for a December offense; sentenced to 18 months in prison, of which 12 months were suspended for probation; ordered to pay a $50 initial and $15 monthly probation user's fee and to complete an alcohol treatment program; and driving privileges suspended for life was Tonya Clow, 47, Syracuse. Nonsupport Of A Child - Given a 36-month suspended prison term in a January case; ordered to pay all child support as it becomes due, plus $25 per week toward the arrearage, and to maintain current employment; and banned from consuming alcoholic beverages during the term of probation was Jack Morris, 42, North Webster.
Criminal Recklessness (Class A Misdemeanor) - Fined $200 for a November offense; sentenced to one year in jail, of which all but 12 days were suspended for probation; ordered to pay a $25 initial and $15 monthly probation user's fee, to make restitution for property damage, to complete an alcohol treatment program and to attend a Drunk Driving Impact Panel meeting; and license suspended 60 days was Verlin B.
