Superior Court III
The following violations were recently admitted and adjudged in Kosciusko Superior Court II with Judge Joe V. Sutton presiding. Unless otherwise indicated, the conviction is for a Class D felony. The month the incident occurred is included to eliminate confusion.
The following people also paid $125.50 in court costs during sentencing between Jan. 4 and Feb. 21:
Driving While Intoxicated - Fined $100 in July; sentenced to one year in jail; ordered to pay a $400 state alcohol countermeasure fee and to complete an alcohol treatment program at Bowen Center; and license suspended one year was Marc Cameron Shea, 37, Warsaw. Shea also was sentenced to 180 days in jail and had his license suspended 180 days for leaving the scene of an accident. The jail terms were ordered served concurrently. Fined $200 in August; sentenced to two years in jail, of which all but 90 days were suspended for probation; ordered to pay a $200 state alcohol countermeasure fee, a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program at Bowen Center, to refrain from consuming alcoholic beverages and to attend one Drunk Driving Impact Panel meeting; and license suspended one year was Mark Hoppus, 39, North Webster.
Fined $200 in October; sentenced to two years in jail, of which all but 90 days were suspended for probation; ordered to pay a $200 state alcohol countermeasure fee, to complete an alcohol treatment program at Bowen Center and to attend one Drunk Driving Impact Panel meeting; and license suspended one year was Dave L. Lengacher, 51, Warsaw.
Fined $200 in August; sentenced to two years in jail, of which all but 90 days were suspended for probation; ordered to pay a $200 state alcohol countermeasure fee, a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program at Bowen Center and to attend one Drunk Driving Impact Panel meeting; and license suspended 180 days was Chad H. Hartman, 30, Warsaw. Hartman also was sentenced to one year in jail, with all but 90 days suspended for probation; ordered to pay a $200 drug interdiction fee; and his license was suspended for 180 days for possession of marijuana, a Class A misdemeanor. The jail terms were ordered served concurrently.
Fined $100 in October; sentenced to 1-1/2 years in jail; ordered to pay a $300 state alcohol countermeasure fee and license suspended two years was Timothy J. Wroblewski, 27, Syracuse. Wroblewski also was sentenced to 60 days in jail and his license was suspended one year for driving while suspended, a Class A misdemeanor. The jail terms were ordered served concurrently.
Fined $200 in September; sentenced to two years in jail, of which all but 120 days were suspended for probation; ordered to pay a $200 state alcohol countermeasure fee, a $50 initial and $15 monthly probation user's fee and to attend one Drunk Driving Impact Panel meeting; and license suspended one year was Paula Shuey, 27, Rochester.
Fined $500 in July; sentenced to three years in jail, of which six months were suspended for probation; ordered to pay a $200 state alcohol countermeasure fee, a $50 initial and $15 monthly probation user's fee, to refrain from consuming alcoholic beverages, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel meeting; and license suspended one year was Ronnie Sexton, 60, Pierceton.
Fined $300 in July; sentenced to three years in jail, of which two years were suspended for probation; ordered to pay a $200 state alcohol countermeasure fee, a $50 initial and $15 monthly probation user's fee, to refrain from consuming alcoholic beverages, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel meeting; and license suspended one year was Jerry R. Hyde Jr., 36, North Webster.
Fined $200 in September; sentenced to two years in jail, of which all by 60 days were suspended for probation; ordered to pay a $200 state alcohol countermeasure fee, a $50 initial and $15 monthly probation user's fee, to refrain from consuming alcoholic beverages, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel meeting; and license suspended one year was Shawn P. McClarnon, 25, Leesburg.
Sentenced to three years in jail for a November offense; ordered to pay a $200 state alcohol countermeasure fee and to complete an alcohol treatment program; and license suspended two years was Regina Stocklin, 31, Syracuse. Stocklin also was sentenced to three years in jail and had her driving privileges suspended for life for a charge habitual traffic violator, a Class D felony, and was sentenced to one year in jail, ordered to pay a $200 drug interdiction fee and had her license suspended 180 days for possession of marijuana, a Class A misdemeanor. The jail terms were ordered served concurrently.
Fined $1 in August; sentenced to three years in jail; ordered to pay a $300 state alcohol countermeasure fee; and license suspended two years was Roggie L. Looney, 44, Goshen. Looney also was sentenced to six years in jail and his driving privileges were suspended for life for a charge of habitual traffic violator, a Class C felony, and six months in jail for false informing, a Class B misdemeanor. The jail terms were ordered served concurrently.
Fined $100 in September; sentenced to 1-1/2 years in jail, of which six months were suspended for probation; ordered to pay a $300 state alcohol countermeasure fee, a $50 initial and $15 monthly probation user's fee and to complete an alcohol treatment program; and license suspended one year was Jeremy Guthrie, 29, North Manchester.
Habitual Traffic Violator - Sentenced for a September offense to three years in jail, of which 1-1/2 years were suspended for probation, and ordered to pay a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program at Bowen Center, to refrain from consuming alcoholic beverages and to attend one Drunk Driving Impact Panel meeting was Joseph Oswald, 22, Syracuse. Oswald also was sentenced to one year in jail, ordered to pay a $100 fine and a $200 state alcohol countermeasure fee and his license was suspended one year for driving while intoxicated, a Class A misdemeanor. The jail terms were ordered served concurrently to each other and consecutive to a conviction in Kosciusko Superior Court III for a July offense.
Sentenced for an October offense to three years in jail, of which 1-1/2 years were suspended for probation, and driving privileges suspended for life was Gregory R. Flynn, 38, North Webster. Flynn also was sentenced to one year in jail; ordered to pay a $200 fine and a $300 state alcohol countermeasure fee; and his license was suspended 180 days for driving while intoxicated, a Class A misdemeanor. The jail terms were ordered served concurrently.
Fined $400 in November; sentenced to three years in jail, of which 1-1/2 years were suspended for probation; and driving privileges suspended for life was Daniel W. Fulk, 30, Syracuse.
Nonsupport Of A Child - Fined $1 in September; given a three-year suspended jail sentence; and ordered to pay $96 per week in child support, plus $3,000 for the first year of the suspended sentence and $3,500 for each year thereafter toward the arrearage was Gary R. Prater, 29, Monticello, Ky. Prater also was ordered to remain gainfully employed.
Fined $1 in September; sentenced to three years in jail, of which two years were suspended for probation; and ordered to pay a $50 initial and $15 monthly probation user's fee and to pay child support as it becomes due, plus $2,000 per first year toward the arrearage was Joshua L. Miller, 24, Huntington.
