Superior Court III
The following violation were recently admitted and adjudged in Kosciusko Superior Court III with Judge Joe V. Sutton presiding. Unless otherwise indicated, the conviction is for a Class D felony. The month the incident occurred is included to eliminate confusion.
The following people also paid $129.50 in court costs during sentencing during February:
Driving While Intoxicated - Fined $120.50 for an August offense; sentenced to two years in jail, of which all but 60 days were suspended for probation; ordered to pay a $200 alcohol interdiction fee, a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program, to attend one Alcoholics Anonymous meeting per week and to attend one Drunk Driving Impact Panel meeting; and driving privileges suspended one year was Joshua Adam Fitzpatrick, 23, Warsaw. The jail term can be served in work release if Fitzpatrick is qualified for and accepted to the program.
Fined $70.50 for a November offense; sentenced to 36 months in jail, of which all but 60 days were suspended for probation; ordered to pay a $200 alcohol interdiction fee, a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel meeting; and driving privileges suspended one year was Christopher R. Anderson, 29, Warsaw. The jail term can be served in work release if Anderson is qualified for and accepted to the program.
Fined $20.50 for a November offense; sentenced to three years in jail, of which all but 60 days were suspended for probation; ordered to pay a $200 alcohol interdiction fee, a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel meeting; and driving privileges suspended one year was Scott A. Leedy, 30, Pierceton. The jail term can be served in work release if Leedy is qualified for and accepted to the program.
Fined $70.50 for a November offense; sentenced to 18 months in jail, of which all but 60 days were suspended for probation; ordered to pay a $200 alcohol interdiction fee, a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel meeting; and driving privileges suspended one year was Randall C. Brady, 47, Leesburg. The jail term can be served in work release if Brady is qualified for and accepted to the program.
Fined $20.50 for a September offense; sentenced to three years in jail, of which all but 60 days were suspended for probation; ordered to pay a $200 alcohol interdiction fee, a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel meeting; and driving privileges suspended one year was Thomas C. McClure, 21, Claypool. The jail term can be served in work release if McClure is qualified for and accepted to the program.
Fined $100 for a November offense; sentenced to 1-1/2 years in jail, of which three months were suspended for probation; ordered to pay a $200 alcohol interdiction fee and to complete an alcohol treatment program; and driving privileges suspended one year was Mark D. Dyer, 49, Warsaw. The jail term can be served in work release if Dyer is qualified for and accepted to the program.
Fined $129.50 for an October offense; sentenced to 36 months in jail, of which all but 60 days were suspended for probation; ordered to pay a $200 alcohol interdiction fee, a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel meeting; and driving privileges suspended one year was Terry L. Smith, 42, Syracuse. The jail term can be served in work release if Smith is qualified for and accepted to the program.
Driving While Adjudged A Habitual Traffic Violator - Fined $120.50 for an August offense; sentenced to two years in jail, of which all but 90 days were suspended for probation; ordered to pay a $50 initial and $15 monthly probation user's fee and to complete an alcohol treatment program; and driving privileges suspended for life year was Bud Richard Phillips, Warsaw. The jail term can be served in work release if Phillips is qualified for and accepted to the program.
Driving While Intoxicated (Class A Misdemeanor) - Fined $129.50 for a January offense; sentenced to one year in jail, of which all but 60 days were suspended for probation; ordered to pay a $200 alcohol interdiction fee, a $50 initial and $15 monthly probation user's fee, to complete an alcohol treatment program and to attend one Drunk Driving Impact Panel meeting; and driving privileges suspended one year was Paul Ramirez, 28, Warsaw. The jail term can be served in work release if Ramirez is qualified for and accepted to the program.
Fined $129.50 for a November offense; sentenced to six months in jail, of which all but 30 days were suspended for probation; ordered to pay a $200 alcohol interdiction fee and to attend at least one Alcoholics Anonymous meeting each week; and driving privileges suspended one year was Peter Joseph Radcliffe, 41, Warsaw. The jail term can be served in work release if Radcliffe is qualified for and accepted to the program.
Nonsupport Of A Child - Fined $1 for a November offense, given a three-year suspended jail sentence and ordered to pay child support as it becomes due, plus $1,380 per year toward arrearage was Andrew J. Himes, 27, Claypool.
Fined $21 for a January offense, given a three-year suspended jail sentence and ordered to pay child support as it becomes due, plus $100 per month toward arrearage was William L. Medley, 40, Rochester.
