Syracuse Zoners Approve Two Petitions With Conditions Attached

SYRACUSE - Both petitions for variances before the Syracuse Board of Zoning Appeals Thursday were approved - with conditions.

Peter Barrett's petition sought a variance to allow a 3-foot-tall fence to remain as placed 11 inches from the north road right of way. The property is on the east side of Front Street and 160 feet southeast of Carroll Street at 502 N. Front St., Syracuse.

Plan commission assistant planner Matt Sandy said under the county ordinances, fences are required to be set back at least 2 feet from all rights of way. The fence, however, is on private property and the right of way is undeveloped.

A letter of support for Barrett's petition was sent by Harold and Donna Shrock to the plan commission. There were no remonstrators against the petition.

"I don't have any problem with it," said Steve Sharp, BZA member. He made a motion to approve the petition with the condition that if the fence is damaged due to improvements to the right of way or snow plowing or similar reasons, no claims can be made against the county or town of Syracuse or the BZA.

Barrett told the board he was fine with that condition and the petition was approved 4-0.

In the other variance petition, John Hoover asked the board to permit allowing an existing garage to remain as constructed 7 feet from a rear property line and to allow a carport to be constructed 7 feet from the rear and 5 feet from the west property line.

The property is on the south side of Chicago Street and zero feet south of Front Street at 215 E. Chicago St., Syracuse.

The petition unanimously was approved with the condition that Hoover's two lots be deeded together. Also, if Hoover's adverse possession of 15.5 feet south of the property is legally challenged and it is found Hoover doesn't own the strip as his attorney Bob Reed said he does, then the BZA decision is null and void.

Members of the Syracuse BZA present Thursday were chairman Larry Coplen, Jon Brookmyer, Steve Sharp and Andy Kitson. Not present at the meeting was Gus Duehmig. [[In-content Ad]]
