SHORTT, Defendants IN THE KOSCIUSKO CIRCUIT/SUPERIOR COURT CAUSE NO. 43D03-0905MF-555 COMES NOW the Plaintiff, Lake City Bank. ("Lake City"), by counsel, having filed its Complaint and Affidavit in the above-entitled cause, hereby requests that the Clerk of Kosciusko Circuit/Superior Court, issue the Summons by publication as follows: 1. This Summons by publication is specifically directed to Defendants, The Unknown Heirs of Michael Shortt aka Michael R. Shortt, deceased, whose last know addresses and their present addresses are unknown. 2. The nature of the above-captioned cause is that on August 26, 2004, Michael Shortt aka Michael R. Shortt (referred to herein as "Shortt") executed and delivered to Lake City a certain Promissory Note (the "Note") by which he promised to pay to the order of Lake City the sum of $38,370.58, together with interest and as of May 13, 2009, there is a principal balance due and owing to Lake City in the amount of $32,684.39. 3. The Note is secured by a Mortgage upon certain real estate, said Mortgage being executed on February 16, 2001. The real estate, which is the subject matter of this cause, is described as follows, to wit: Lot numbered one hundred twenty-nine (129) and five (5) feet off the east side of lot numbered one hundred thirty (130) in Burger's First Addition to Riley Memorial Beach, Section One (1), township thirty-two (32) north, range seven (7) east, as platted and recorded in old plat book number five (5) at page one (1) of the records of Kosciusko County, Indiana. More commonly known as 9 EMS R4G Lane, Pierceton, IN 46562 (the "Real Estate") 4. Lake City has accelerated the entire balance due and owing on the Note and Mortgage, due to Jordan's failure to make the required payments. Shortt is also responsible for pre judgment interest as set forth in the Note and reasonable attorney fees. 5. The Defendants, The Unknown Heirs of Michael Shortt aka Michael R. Shortt, deceased, named herein must answer this Summons in writing, personally or by counsel, on or before thirty (30) days from the date of the third publication thereof.
