Miller Whereabouts: Unknown BE IT KNOWN that on the 29th day of June, 2009, Farmers State Bank, Plaintiff, by its attorneys, Rockhill Pinnick LLP, filed in the Office of the Clerk of the Kosciusko Circuit Court of Kosciusko County, in the State of Indiana, a Complaint on Promissory Note and to Foreclose Real Estate Mortgage against the above named Defendant, Richard A. Miller, and that the Plaintiff has caused to be filed in the Clerk's Office an Affidavit showing that the residence of the Defendant, Richard A. Miller, upon diligent inquiry, is unknown and that the Defendant, Richard A. Miller is not now believed to be residing in the State of Indiana and that said cause is for the collection of a certain real estate mortgage note, together with interest and costs, and for the foreclosure of a certain real estate mortgage given as security therefor, in which real estate the Defendant, Richard A. Miller, claims an interest and which real estate is more particularly described as follows, to-wit: A tract of land located in the Northwest Quarter of Section 35, Township 34 North, Range 5 East, Jefferson Township, Kosciusko County, Indiana, more particularly described as follows: Commencing at a bronze marker at the Northwest corner of the Northwest Quarter of said Section 35; thence North 89 degrees 51 minutes 10 seconds East (recorded bearing), along the North line of said Northwest Quarter and within the right-of-way of County Road 900 North, 1422.28 feet (recorded), to a Mag nail set in the surface of said County Road for the Place of Beginning; thence continuing North 89 degrees 51 minutes 10 seconds East along said North line, 152.00 feet to a Mag nail; thence South 00 degrees 08 minutes 50 seconds East, 206.00 feet to an iron pin; thence south 89 degrees 48 minutes 31 seconds West, 404.45 feet to an iron pin; thence North 00 degrees 08 minutes 50 seconds West, 50.87 feet to an iron pin set in a fence line; thence North 89 degrees 48 minutes 31 seconds East, along said fence line, 260.00 feet to a rail iron post; thence North 03 degrees 24 minutes 50 seconds West, 155.43 feet to the Point of beginning. NOW, THEREFORE, the Defendant, Richard A. Miller, is hereby notified of the filing and pendency of said Complaint against said Defendant and that unless said Defendant appears and answers or otherwise defends said Complaint within thirty (30) days after the last publication of this Summons, the matters and things therein contained and alleged will be heard and determined in the absence of said Defendant, and judgment by default may be entered against said Defendant for the relief demanded in said Complaint.
