CAUSE NO. 43D03-1208-MF-0220
    COMES NOW the Plaintiff, Lake City Bank ("Lake City"), by counsel, having filed its Complaint and Affidavit in the above-entitled cause, hereby requests that the Clerk of Kosciusko Circuit/Superior Court issue the Summons by publication as follows:
    1. This Summons by publication is specifically directed to Defendants, Heirs and/or Devisees of Ricky R. Richardson, Deceased, whose last known addresses and their present addresses are unknown.
    2. The nature of the above-captioned cause is that on December 23, 1992, Ricky R. Richardson ("Richardson") executed and delivered to Lake City as certain Promissory Note (the "Note") by which he promised to pay to the order of Lake City Bank the sum of $45,150.00, together with interest and as of August 11, 2012, there is a principal balance owing in the amount of $27,186.82.
    3. To secure payment of the Note, Richardson executed and delivered to Lake City a Mortgage upon certain real estate, said Mortgage being executed on December 23, 1992. The real-estate, which is the subject of this matter, is described as follows, to wit:
    Part of the southwest quarter of Section 7, Township 34 North, Range 7 East, Kosciusko County, Indiana, more particularly described as follows, to wit:
    Beginning at a railroad spike found at the point of intersection of the north line of said southwest quarter and the centerline of Kern Road; thence north 89 degrees 52 minutes 55 seconds east, on and along said north line, a distance of 200.00 feet to an iron pipe found; thence south 00 degrees 55 minutes 18 seconds west, a distance of 149.63 feet to an iron pin found; thence north 73 degrees 42 minutes 007 seconds west, a distance of 258.48 feet by a railroad spike found on the centerline of said Kern Road; thence north 33 degrees 22 minutes 36 seconds east, on and along the centerline of said Kern Road, a distance of 91.8 feet to the point of beginning.
    Commonly known as 12486 N. Kern Road, Syracuse, IN 46567 (the "Real Estate").
    4. Lake City has accelerated the entire balance due and owing on the Note and Mortgage, due to Richardson's failure to make the required payments to Lake City. Richardson is also responsible for prejudgmnt interest as set forth in the Note and reasonable attorney's fees incurred by Lake City.
    5. The Defendants, Heirs and/or Devisees of Ricky R. Richardson, Deceased, named herein must answer this Summons in writing, personally or by counsel, on or before thirty (30) days from the date of the third publication hereof. If said Defendants fail to do so, judgment may be rendered against them for the relief demanded.
