Stimmel Transfer Request Irks Alcohol Board

Sam Stimmel's alcoholic beverage permit stock transfer request riled the Alcohol and Tobacco Commissioners Thursday.
After approving a beer, wine and liquor permit renewal for Stimmelators Gentlemen's Club in Tracy Stimmel's name, the board addressed the transfer of stock, switching ownership back to Sam, Tracy's father.
Excise officer Pat Fleck swore in the Stimmels, and Sam answered routine permit questions. He indicated he had been a continuous resident of Indiana. Commissioners Gordon Vanator, Ken Johnson and Elim Smith doubted the truth of that statement.
Stimmel's residency came into question last year when he indicated he was a resident of Texas when applying for an alcoholic beverage permit for a bar in Texas.
In February, while the matter was being investigated in Texas and Indiana, a transfer of stock to Tracy was approved. At that time, the Stimmels said making Tracy manager of the club had been their goal all along.
Yesterday, those goals had evidently altered and the board was not pleased.
Sam said the club had a "rough winter" financially. He said he couldn't retire and didn't feel right taking a salary from the business when he couldn't help manage it.
He presented a document indicating he was cleared of making a false report in Texas.
"You claimed residency in Texas within the last five years," said Smith.
Sam said he had a residence, an apartment, in Texas. The case of false reporting had been dismissed in the Lone Star state.
"I told them I lived in Indiana," he said.
Fleck suggested the application be continued until residency has been determined, which the board approved. She said the stock request would be continued until she could get an answer from Texas authorities.
"We were very, very humble in dealing with your situation. I'm disturbed to see this come back around," said commission president Vanator.
"Sam perjured himself the last time. How do we know he isn't [perjuring himself] this time?" Johnson asked.
A regional vice president of the Ruby Tuesday Corp. appeared to assume the transfer of stock for the permit assigned to the 3308 E. Center St., Warsaw, restaurant.
The Michiana Franchise representative said there were four other Ruby Tuesday's in Indiana and the corporation was taking over all of them.
A new beer, wine and liquor permit was issued to Kroger Limited Partnership, doing business as Owen's at 2211 E. Center St., Warsaw. The store is adding a liquor aisle.
The commission also approved a beer and wine renewal permit to Shamrock Pizza, Ind. 15N, Silver Lake.
The permit has been in escrow for several months and transfer of stock will come later.
Fleck said new state statues will allow a permit to be in escrow for six months. Within half a year, the permit must be reactivated or sold. If no action is taken, the state agency will then decide what to do about the permit.
The board approved renewal of several permits. None of the following establishments have been cited with violations:
• Beer and wine permit for the Boathouse Restaurant 700 Park Ave., Winona Lake. Chris Katris, president and James Katris, secretary. Both officers live in Warsaw;
• Beer, wine and liquor permit for Night Shift of North Webster, 114 E. Washington St., North Webster doing business as Stimmelators Gentlemen's Club. Tracy Stimmel, Syracuse, president and secretary;
• Beer and wine permit for Kroger Limited Partnership, doing business as Owen's, 302 W. Market St., Warsaw;
• Beer, wine and liquor permit for the Veterans of Foreign Wars 1342, 307 W. Chicago St., Syracuse;
• Beer, wine and liquor permit for J.F. Inc., 134-6 N. First St., Pierceton, doing business as The Post. James Felts, Leesburg, is president and Christie King, Pierceton, is secretary;
• Beer and wine permit for Lance's Super Dollar, 726 S. Huntington St., Syracuse, doing business as Lance's New Market. Daniel Lance, Roanoke, is president; Douglas Lance, Marion is secretary;
