Speedy Trial Rule Forces Release Of Murder Suspect

A Millersburg man charged with murder in the death of a Milford woman was released on bond Wednesday.

Based on an Indiana Supreme Court rule, Kosciusko Circuit Court Judge Rex Reed ruled Wednesday that Jason Fisher, 23, should be released because his right to a speedy trial was violated in relation to the murder charge against him.

Fisher was charged with murder and jailed without bond on Jan. 25, 2001.

Reed cited Criminal Rule 4 which mandates that defendants held without bond for a period in excess of six months must be released on their own recognizance.

The rule also states that the defendent is subject to trial on those same charges if brought to trial within a year of the filing of the charges.

It has been more than a year since Fisher was charged in the murder case, but several delays in his case were attributed to his own actions. Those delays pushed back the six-month deadline for his release, and also pushed back the one-year deadline for him to be tried on the murder charge.

Fisher also faces charges of Class C felony burglary and Class D felony theft. He was charged with those crimes in December 2001.

Those charges result from a December 2000 theft of more than $100,000 worth of vehicles from Rice Ford in Warsaw. Three other men already have been sentenced for their role in the burglary.

Fisher posted $5,000 surety bond on the burglary and theft charges.

Fisher bonded out at 4:03 p.m. Wednesday.

The murder charge results from the Jan. 15, 2001, shooting death of Kathy Vroman, 48, of Milford.

Police believe Vroman was shot to death at a used car lot in Milford operated by the Fishers. Her body was transported to Michigan and dumped in a rural area, police reports indicate.

Fisher recently accused his father of committing Vroman's murder. Subsequently, Ralph Freddrick "Fred" Fisher, 47, Goshen, was charged with murder. The elder Fisher is being held without bond.

Wednesday, Thomas M. Leatherman of Goshen, attorney for Fred Fisher, said in a press release he will seek to have his client released from custody and the case against him dismissed.

He also filed a notice with the town of Milford and Milford Town Marshal David Hobbs of an intention to sue them for the illegal arrest and incarceration of Fred Fisher. [[In-content Ad]]
