Two men were jailed Tuesday night after one allegedly fired a round from a pistol at the other.
Thomas Lopez, 29, of 330 EMS T26 Lane, Leesburg, is preliminarily charged with criminal recklessness. Bond was set at $5,000. Also charged was Scott Malcolm Hutchison, 35, of 2793 N. CR 600E, Warsaw. He was charged with disorderly conduct and is being held in the Kosciusko County Jail on $350 bond.
According to a Kosciusko County Sheriff's Department report, Hutchison went to the Lopez residence to speak with his ex-wife, Candace Lopez, about a visitation dispute concerning their children.
A KCSD press release noted that Hutchison and Candace Lopez have a history of custody disputes.
Hutchison reportedly arrived at the residence about 7:30 p.m. with a metal baseball bat and struck the vehicle Candace Lopez was driving while she was in the driveway. Hutchison allegedly followed his ex-wife home after exchanging custody in Oswego.
Thomas Lopez then came out of the residence and, when he saw Hutchison, reportedly went back inside for a handgun. One shot was fired at Hutchison's car, shattering a window and lodging in the passenger-side headrest. Hutchison was seated in his vehicle when the shot was fired and immediately left the area but was later located by police. Hutchison was showered in glass, but was not injured in the incident, police said.
Hutchison's car and Lopez's .380-caliber handgun are being held as evidence in this case. One spent casing was recovered from the driveway.
The incident remains under investigation. [[In-content Ad]]
