By virtue of a judgment and decree of foreclosure, a copy of which has been duly issued, certified and to me directed by the Clerk of the Kosciusko Circuit Court in the certain cause bearing Cause Number 43COl-1512-MF-143 upon the docket of said Court, wherein MutualBank is the plaintiff and David J. Mcilwain, Kimie L. Mcilwain and State of Indiana are the defendant, requiring me to make the aggregate sum of One Hundred Twenty-three Thousand Four Hundred Eighty and 35/100 Dollars ($123,480.35) for payment of the judgment of said plaintiff against the defendant, David J. Mcilwain with interest thereon from the date of said decree, namely, March 18, 20 16, at the rate and with costs provided and ordering the sale of real estate hereinafter described to make assets for the payment of said judgment and decree, I will expose and offer for sale at public auction to the highest bidder on

A tract of land in the Northeast Quarter of Section 15, Township[ 33 North, Range 7 East, Tippecanoe Township, Kosciusko County, Indiana, further described as follows:
Commencing at a point 40 feet South (record) and 72 feet West (record) of the Southeast comer of Lot Number 5 of Luther Strombeck's Addition to North Webster; thence continuing West (assumed and basis of bearings) 233.4 feet (229.6 feet record) to a P.K. nail of the East line of State Road Number 13; thence Southeasterly along said East line and being a curve to the left (radius 914.93 feet per state highway plans) 23.5 feet to a concrete right-of-way marker; thence continuing along said East line South 21 degrees 45 minutes East 173.53 feet to a 1/2 inch rebar found and being the point of beginning; thence continuing South 21 degrees 45 minutes East along said East line, 3.48 feet to the back edge of a concrete right-of-way marker; thence continuing Southeasterly along said East line. and being a curve to the left 105.35 feet and having a radius of 914.93 feet (subtended by a chord bearing South 30 degrees 55 minutes 24 seconds East 105.30 feet) to a 5/8 inch capped iron rebar; thence North 87 degrees 43 minutes 30' seconds East 108.70 feet (east 106 feet record) to a 5/8 inch iron pipe in concrete; thence North 00 degrees 28 minutes 15 seconds West (North record) 125.5 feet to a 5/8 inch iron pipe in concrete; thence South 77 degrees 27 minutes 58 seconds West (West record) 166.96 feet to the point of beginning.
The above-described real estate for information purposes only, is located at 611 South Main Street, North Webster, Indiana 46555.
The aforesaid sale of real estate will be made without any relief from valuation or appraisement laws, and without any right of redemption therefrom. The terms of said sale will be cash. The Sheriff will issue to the purchaser of the aforesaid real estate a Sheriffs Deed.
