"I'm tired of taking this Forest Park on promises," said Kim Leake, Warsaw public works superintendent, who sits on the city's plan commission, in a statement that summed up the complaints heard by the Warsaw Plan Commission Monday from more than 15 homeowners in the Forest Park Development.

The plan commission Monday heard the concerns of the homeowners who live in the Forest Park development.

Ben Music, who represented the Fort Wayne developer, said, "I'll do everything I can to make you happy."

Many of the concerns brought up by the homeowners were not addressable by the board. Mike Valentine, Warsaw city attorney, told the concerned homeowners their best choice might be to put a group together and hire a private attorney to take care of several breach of contract issues.

The issues the board can and will be addressing are three delinquent sewer tap bills, the lack of building permits for several existing homes, the lack of a required third turn-around, the developer coming into compliance with existing violations and the lack of "no parking" signs in Forest Park.

Leake insisted that Music have a trailer moved off one of the lots in the phase two section of the development since it was agreed during the April meeting there would be no further development in that area.

Some of the issues the board could not address included the lack of drainage, the lack of locks on the lift station and inadequate foundations. One homeowner commented they could no longer open their back door because their house sinking.

Rick See, spokesman for the homeowners, said safety was the main concern. With the lack of locks on the lift stations, many of the parents of small children were concerned they might get curious and look inside. Small children could easily fall into the hole and get swept away.

"Is a child going to have to die?" asked a homeowner.

Leake said if there were no locks by the next day, the homeowners should call him and he would buy them himself and put them on. [[In-content Ad]]
