On or about June 26, 2013 the Town of Mentone IN will submit a request to the Indiana Housing and Community Development Authority (IHCDA) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertaken project known as:
Project title: Mentone Owner Occupied Rehab Program
Purpose/Scope of project: Repairs and retrofits to owner occupied homes on scattered sites
Estimated funding: $250,000
Project location if applicable: Within the town limits of Mentone
The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Housing Opportunities of Warsaw, In at 109 W Catherine Street, Milford IN where ERR can be examined or copied weekdays 8:00 A.M. to 4:30 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Housing Opportunities of Warsaw, Inc. at PO Box 387, Milford IN 46542.
Comments received by June 28, 2013; will be considered by the town of Mentone prior to authorizing submission of a request for release of funds.
RELEASE OF FUNDS
The Town of Mentone certifies to IHCDA that Timothy Croy in his capacity as Mentone Council President consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. IHCDA’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Town of Mentone to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
IHCDA will accept objections to its release of funds and the Town of Mentone certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Mentone; (b)the Town of Mentone has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the Town of Mentone has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by IHCDA; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to IHCDA, 30 South Meridian Street, Suite 1000, Indianapolis, IN 46204. Potential objectors should contact IHCDA to verify the actual last day of the objection period.
