Rape Suspect In Custody In Texas

A Pierceton man is in custody in Edinburg, Texas, after a routine warrant check during a traffic stop Tuesday revealed several outstanding warrants in Kosciusko County.

Maximo P. Ybarra, 22, is being held without bail in the Hidalgo County Jail after officers discovered he is wanted on warrants for three counts of rape (class B felonies), one count of child molestation (class A felony) and one count of theft (class D felony) in Kosciusko County.

"He is being held in Hidalgo County and we are waiting for him to sign extradition papers this week," said Kosciusko County Sheriff's Department Capt. Jim Springer. "If he does not sign them, a governor's warrant will be issued."

If he signs the papers, Ybarra will be transported back to Warsaw and booked into the Kosciusko County Jail as early as next week. Ybarra would be held in the jail until his arraignment or until he posts bond, which is expected to be at least $22,000.

A governor's warrant could take 60-90 days to be approved, and then Ybarra would be forced to return to Indiana to face charges.

Although police do not know why Ybarra was in Texas, they speculate that he may have been trying to leave the country.

"The town where (Ybarra) was found is right on the border," said Springer. "I am assuming he was on his way back to Mexico."

According to a police report filed July 21 at the Kosciusko County Sheriff's Department, three juvenile girls reported being raped at a residence on Channel Road in Warsaw.

The three girls, ages 13, 16, and 17, said they were sleeping at approximately 1 a.m. July 21 when Ybarra allegedly reached into an open window and pulled them outside and raped them in a neighbor's yard.

After raping the girls, Ybarra reportedly kissed each of them, stood up, laughed and left the scene after telling the oldest girl he would kill her if she told anyone.

The girls were taken to Kosciusko Community Hospital later that day and examined.

"We were looking for him the week after the incident happened and had several reported of him being spotted," said Springer. "Those reports were erroneous. After that, we were hoping someone would pick him up on a traffic violation so we could take him into custody."

The theft case goes back to an May incident at Maple Leaf Farms, where he allegedly broke a window in a parked car and stole a purse. [[In-content Ad]]
