Property owners to continue overseeing piers, sheds

Camelot Owners Association petitioned the Kosciusko County Board of Zoning Appeals Wednesday to allow the assocation to continue regulating pier, platform, stairs and shed placement along Camelot Lake, a request the BZA approved.

Homeowners with property bordering the private lake have turned to the organization for such installations for decades, said lawyer Rick Helm. And they wish to continue to do so.

The subdivison was established around a former gravel pit and there is a considerable drop to the lake shore in many areas, Helm said. Instead of hauling skiing and boating equipment up and down a 10- to 15-foot slope all summer, sheds have been set in place for everyone's convenience.

The subdivision is south of CR 1300N between CRs 250E and 300E.

"It would be a quagmire to figure out what to ask for, what to approve," Helm said. "Property owners want to keep making their own decisons without complaints."

The BZA asked that sheds be no larger than 10 by 12 feet and be 5 feet from the lake's edge. Permits must still be purchased for structures that require them.

Plan director Dan Richard expressed his ire for the work of building contractor Michael Fourman of Ohio.

Fourman requested a residence and attached garage to remain as constructed 31 feet from the north right-of-way, closer than setbacks granted, and to allow a 6 foot tall fence to remain as placed in a front yard where ordinance calls for three feet high fences.

The property is on the south side of 51 EMS D10 Lane south of CR 1000N in Van Buren Township.

"This is the second time you've been here [in violation of ordinances]," Richard said. "The first time was for a building across from the North Webster Day Care. Your speil then was everything was the contractor's fault. Now you come in and lay this burden on the board. We like to deal with things ahead of time. You're relying on this board to bail you out.

"Attention to detail is your responsibility. You have no where else to go. The truth is you messed up."

Board member Vic Virgil recommended a $2,500 settlement due to neglect, an offer good for 30 days, which the board approved. If it is not paid the board will seek legal recourse against Fourman.

The residence cannot be moved. The two fence sections closest to the road are to be removed or reduced to three feet in height.

The board approved placement of two Cingular Wireless communication towers, providing they will support communication equipment for governmental agencies, too.

Cingular representative Dave Dixon initially wanted to continue the requests, saying the engineers plans are not available. He said adding emergency service repeaters would not be a problem.

The BZA approved exceptions and variances for a tower on the east side of Ind. 15, 651 feet south of CR 1100N in Van Buren Township and one on the south side of CR 500 W, south of US 30 in Prairie Township.

The towers will be placed pending review of engineer plans which were not filed Wednesday.

The board also:

• Approved Scott Sneiff's variance to build an additon to his home at 12113 Mohican Drive. The addition would be 17.6 feet from the road right of way. The property is on the east side of Mohican Drive and 88 feet north of Cherokee Road in Turkey Creek Township.

• Approved George Stanley's variance request with conditions, leaving an 8 by 17 foot deck as placed to remain as placed 10 feet from the road right of way on an undersized tract of ground and to move a small shed to five feet from the west property line.

Stanley has six months to complete the move. The property is at 31 EMS B53 Lane, on the west side of EMS B53 Lane, 285 feet south of Barbee Road in Tippecanoe Township.

• Approved Kim and Cheryl Colby's variance petition to allow a boathouse to be reconstructed with living quarters 0 feet from the north road right-of-way, 5 feet from the side lines and 0 feet from the waters edge on a lot without a principle structure on an undersized lot.

The property is located on the south side of Highland View Drive and 920 feet east of CR 800E in Turkey Creek Township.

• Approved Stephanie Mangun's petition for a home occupation permit for antiques and craft sales in an agricultural district. The property is located on the south side of CR 200S in Harrison Township.
